    A Cautionary tale about being a jerk on youtube

    Adam Smith of Arizona had it all, education, high paying job, nice car. Unfortunately he also has a tendency to be a jerk, in addition to this he likes to film himself being a jerk. It was with these two minor character flaws that our intrepid hero set forth about yesterday. So he goes to chick fil-A, orders only free water. And drives up to verbally abuse the young woman working the window. Telling her that she worked for a hate filled company and that she should be ashamed of herself. He then drives away saying " I guess I did something purposefuL today" his video he took of himself doing this gets posted on YouTube (becuase keeping a private life is Un American) and goes viral. One of those inboxes happens to be his boss. Now mr smith will probably have plenty of time to do something purposeful while collecting unemployment. Less then 12 hours after posting himself being an *** on YouTube he was canned from his position as CFO of an Arizona medical supplier.

    This is so awesome, ha ha!! I feel bad for the girl working the drive-through window; she was just trying to do her job and I'm sure she knows way more about the company she works for than he does!! It's so nice to see karma in action! =)

    What a retard! It never ceases to amaze me the really dumb stuff that people film themselves doing, and then making it public themselves. I hope he enjoys his unemployment!

    The worst thing is that I'm pretty sure that type of guy still thinks he did nothing wrong and would blame everyone else for his actions.

    I have not seen the video yet - we have a streaming filter... So, if the answer to my question lies in the video, I apologize.

    I'm confused how this is any different than the owner of Chick Fil A giving his opinion on what the definition of family is? Yes, he's an idiot for recording it, but.... it's his right to state his opinion. Why should he get fired for it?

    And just for the record - I do NOT share his opinion. My opinion of him, is he's a total idiot, but to get fired for something he did on his personal time? Not so sure I agree with that... Should I get fired from a life insurance company because I smoke in my free time? I do understand that some professions are held to a higher standard when they're off the clock - LEO's. I get that. But, a CFO for a private company? I don't get that.

    Simple.
    The owner of the company can decide how his underlings represent his company. If you make a public spectacle of yourself by telling off a person that has nothing to do with anything the owner of that company can fire you.

    If the head person of a company chooses to make a stand he will get the fallout or benefits by the patrons of that company. If his company takes to much fallout it will close it's doors and the head person will lose his job.

    I could understand that stance better if he were representing the company while he was making those statements. From what I understand he was on his own time when he filmed the episode.

    I am guessing Arizona is an at-will state and there is no arguement there. But I think companies are going too far when they fire people for things they do in their off time. If every company fired their employees for things they did while off, only saints would have jobs.

    Should I get fired from McDonald's because I got a speeding ticket? McDonald's has nothing to do with driving just as Vante has nothing to do with same sex marriage.

    This whole situation is so overblown it makes my blood pressure go up just thinking about it. Mr. Cathy's business should have never been brought into the spot light in the first place. His business has nothing to do with his personal opinions. Just as this fool's anger shouldn't be directed at the business or the people that work there. And his boss should realize that his employee's opinions have nothing to do with Vante's business.

    If everyone would take personal responsibility for their actions and lay the consequences of those actions solely on the shoulders of those responsible, then we wouldn't have to worry about the actions of our employees affecting our businesses. Did that make sense?

    I saw this and was very happy when I found out he had been fired. Sad part is, I am willing to bet a liberal company will probably pick him up and give him a top notch job, and he'll probably come out with a better position potentially.. :(

Why should he get fired for it?

Some employers do require tobacco free workers, for instance private and executive security firms like Gavin De Becker and associates have strict policies against smoking I do understand that some professions are held to a higher standard when they're off the clock - LEO's. I get that. But, a CFO The CFO is a top level executive position. potential customers for Vante and business leaders that do business with Vante are likely to meet the CFO of such a company. Mr Smith identified his name on his youtube channel and showed his full face on the video. what impression does that make for the company with him so well known as the jerk on YT for a private company? I believe vante is a corporation, so would be publically owned, which brings up the issue as to who would invest in their stock if one of their execs is being rude in YT I don't get that. Corporate Execs serve at the pleasure of their boss or the corporate board in the case of CEOs. Execs are an important figure head and can be canned whenever their supervisor feels that they've become a liability

    Ok, now that I watched or rather, listened since it wont seem to play the video.... I kind of recant....

    I still dont think he should have lost his job since he didnt once mention the company, therefor I dont believe he was representing the company at the time he did this.

    With that said, since he did get fired, I guess I will just have to live with it

    It has been long held that any conduct by an employee, either on or off duty, that could easily disrupt or impair the service provided by their employer, or which has the potential for causing discredit to the employer if it were known by members of the public, is grounds for disciplinary action. The focus is on the potential for destructive consequences, not on whether the conduct is intentional.

    This guy was a high ranking manager within the company and as such, was well known to other clients. His off duty conduct was very public and had the potential to bring discredit to this employer in the eyes of clients and the public. It also had the potential to disrupt the employer's business by having to field letters and phone calls from the public complaining about his actions. As a result, it had the potential to damage business.

    It is not reasonable for an employee to compel their employer to take that kind of financial and business risk, just so the employee can exercise their First Amendment rights.
