Feds detail pattern of discrimination by Arpaio
The findings seem pretty lame. All civil. Based on statistics. Statistics that say illegal aliens are more likely to drive a car with expired tags, no insurance and no drivers license than legal residents. Also, statistically in Arizona, illegal immigrants are more likely to be of Hispanic origin. So, therefore, stopping cars with expired tags is racial profiling because they are more likely to be Hispanic. There are apparently no specific incidents they can point to. Just numbers. There are apparently no criminal violations.
The interesting part is the following and I believe is the underlying intent of the probe. This is the fastest I have ever seen the Feds work. I am not sure how significant this will be but it seems this is what the Obama administration was really after. Someone with more knowledge than I can answer what will happen to an illegal immigrant that is arrested for a misdemeanor and taken to the county jail. Will they know? Hopefully, felony arrests will still be run through the system. Every community that regularly runs their arrests through "Secure Communities" program is now on notice. If you catch too many, they will cut you off. As I understand it, everyone is run through so DHS isn't even alleging a misuse of their system so tying it the DoJ report to DHS seems like they are implementing their own discrimination by tying the "Secure Communities" program to Hispanic arrests.
But the fallout from the report was quickly evident: within two hours of Perez revealing the findings, Department of Homeland Security Secretary Janet Napolitano announced that the federal government would remove the sheriff's authority to conduct immigration screenings in the jails.
"The Department of Homeland Security is troubled by the Department of Justice's findings of discriminatory policing practices within the Maricopa County Sheriff's Office," Napolitano said in a statement. "Discrimination undermines law enforcement and erodes the public trust. DHS will not be a party to such practices. Accordingly, and effective immediately, DHS is terminating MCSO's 287(g) jail model agreement and is restricting the Maricopa County Sheriff's Office access to the Secure Communities program."
