If he got a W-2, then he should have disclosed the job on his app. And while I don't know whether he did or didn't in this case, I do know that the mainstream porn industry has been working very hard to legitimize itself in the eyes of the public, lately. Mandatory STD testing, and yes, paying taxes to the gub'ment.

For what it's worth, the article said that the firing was upheld through arbitration, and that says more to me than anything else. If an independant third-party thinks the firing was okay, his litigation attempt at this point smacks of sensationalism, and a money grab. If not, why smear the profession (and organization) you wish to rejoin?

I don't know many Eagle Scouts that appear once in porn flick and don't do anything else that's questionable. I wouldn't be surprised if they would have found more than that if they looked closer. Like Creeker say, they might have forgotten to Google him and they don't want to say how stupid they were for missing it. Who knows?

One more time, there is little doubt in my mind that there is something other than failing to disclose a past one time event job that's behind the firing. This goes against common sense in my mind. I've done work under the table repairing cars, etc when I was younger. That hardly made me immoral. Third party arbitrators don't always impress me either. It will be interesting to see what comes out in court. I'm not defending the guy, I don't know enough about it to make a judgement either way. But if they canned him just for that and the fact he's gay, they're gonna lose.

FWIW, back in the mid 70's we hired a woman who had worked as a topless dancer. She was a newly divorced woman with two little kids and it was better money than she could make as a receptionist somewhere. She finished her career just fine after over 25 years. I can attest that her morals were no worse and probably higher than a lot of people we've hired over the years.

I'm assuming the work would have been 1099 not W-2. He was probably a private contractor. If I had to list every under the table job and 1099 work I've ever done on an application, I wouldn't know where to start.

I've never filled out a police application. But about a month ago I was hired by my former high school and had to fill out quite a large stack of paperwork. Did I miss the yes/no question?: "Did you ever star in a pornographic film?".

I fail to understand the termination of a police officer because he was in a porno before he was hired. In order to discover the film, was one of his superiors looking at homosexual pornography? It's not the same as not disclosing former drug or criminal activities on the application.
