so this morning I leave to go to school in a monster thunder storm it was pouring rain to the point you could only see about a foot in front of you, plus it was dark that was at 7am and it's still currently raining just as hard so anyways I'm driving going about 30mph and I see this large black moving object in the rd directly in my path so I stop and sit and wait... my perception at first made me think it was a black horse ( the people down the rd from us have horses) finally it moved to the shoulder of the rd it was a guy walking with his arms outstretched with a black rain poncho like cape.... my first thought was what dummy would be out in this weather, in the dark with a black cape...thank god I seen him when I did... then my second thought was poor guy not only did he almost get run over but he's out walking in this weather.......CRAZY....

and I see a eye exam in my very near future....lol

Pedestrian vs Cars are far to often.. You always need to take into consideration weather when driving. Especially if you can't see.

Yes, it was indeed a lesson well learnt for sure, it scared me really bad if I would have been going a little bit faster I would have hit him.. it was extremly hard to see this morning but still it would have been my fault :( i thought about turning around and offering him a ride but even that would not have been a very smart thing to do I felt bad for him though, and it made me realize ok maybe I do need to wear glasses when driving ESP since I thought he was a HORSE! going to get my eyes checked in a few..

In general, I think if person is outside crosswalk, they are fair game. In a crosswalk, whether marked or unmarked (in arizona, I believe it's presumed that a crosswalk exists at any intersection regardless of whether it's painted - not a leo though). I don't know if there are extenuating circumstances (i.e. reckless pedestrian?) but I don't think weather would be one as you shouldn't be going faster than is prudent for the conditions (and the conditions include pedestrian crosswalks on the road during rainstorms ). Not a leo though so YMMV as to whether you would be cited or faulted criminally.

I covered one of those a few years back. Only the driver was traveling 13 over the speed limit in the heavy ran. The female he hit crossing the road had a bright pink raincoat on, and then he left the scene and when found him he lied and said he hit a deer. He got 5 years in prison.

5 years? that's all he got ?.... wow...where I was at I was going 15 under the speed limit due to the weather THANK GOD I was though or he would have been a hood ornament...ugh still bothers me...he was probably on drugs he had to of been to be out in the weather ( hailstorm) standing still in the middle of the road like that.
