    If the officer was not wearing his hat he has no official authority over you as he was out of uniform. If an officer is out of uniform he by law can't write you a ticket so I would also bring this up in court if it was the case.

    Ask the judge for a Department of Motor Vehicles ID-10-t form to contest the legality of his traffic stop while out of uniform. If you have anymore questions feel free to ask. I hope this helped, I know the peanut gallery was of no help.

    There's no such thing as a "random pull over". Look up Delaware v. Prouse.

    If you received a ticket for driving 43 MPH you can rest assured that you were traveling 43 MPH when the officer said you were.

    It is no more likely that you drive down the road completely focused on your tachometer than it is likely other people drive down the road completely focused on their speedometer.

    I have no doubt that at some point you looked at your tach and saw it displaying 1500 rpm. You probably looked at it after you saw the police car, which is what most people do with their speedometer. The normal sequence of events goes something like this:

    1) Cop sees a speeding vehicle traveling at 43 MPH in a 25 MPH zone and measures its speed with laser or radar.

    2) Driver sees cop and immediately eases up on the accelerator or taps the brakes.

    3) Driver then glances at the speedometer (after the car has already started to slow, and LONG after their speed has already been measured) and sees it is 36 MPH.

    4) Driver whines and moans about the unethical cop who is lying about how fast they were driving, because the driver is 100% certain they were only doing 36 but the nasty mean cop is, for some unknown but surely nefarious reason, trying to claim they were doing 43 MPH.

    Sorry we do not use tuning forks to calibrate our radars. The radar has internal tests to verify its working. We have to verify that the radar was working at the beginning of the shift and end of the shift and note it on our daily log.

    Like people have said fight the ticket, if you do not feel you were responsible. There is no law that you have a speedometer in your vehicle, but using RPM's to guage your speed is not accurate to me.

    I suggest you go into court and tell the judge that your defense is that although you're speedometer is broken, you have calculated your correct speed that day, and that you were not speeding nearly as much as you were charged with, and besides, the officer didn't use his "tuning forks" that day.

    Don't forget to add it that he did not have his hat on, and I think you are looking good on this one.

    I can't fricken believe all of these answers to an Ask a Cop in the Rap Sheets. :D

    I am also wondering if I can get some free postage, I mean, since you work with us cops & all by delivering our mail at the college.

    It is no real wonder that you seem to be inattentive to your driving, since you must be constantly calculating your gear ratio vs tach rpms to determine your actual speed. I'm wondering if the grade of the road or downhill driving enters into the calculation at all...does your car still go 36 mph at 1500rpms in 5th gear when you are driving uphill?

    I am pretty sure that is why there is things like a speedometer mounted in cars.

    Another thing you might bring up in court was wether the cop used black or blue ink in the pen that he wrote the ticket with. If he used the wrong color, that is the clincher, and you won't even need to bring up the fact that you have no speedo in court.
