OK long story, lots of questions, so sorry in advance!!
First part - my step-sister's boyfriend got a (first) DUI in MN while living in WI. He is very hard of hearing so when he went to court, he missed out on most of what was going on because he's stubborn and annoying. Obviously his MN driving privileges were taken away, but what about his WI ones? If his WI driving privileges were taken away, is there any option for a license that would allow him to drive to work?
Second part - same idiot - my stepsister lives with me (in Maplewood MN) and said boyfriend moved in for a few months, then he got drunk and they got into a fight. He ended up causing her moderate injuries to her face when he threw a glass in her face (3 cuts with 16 stitches). He ran off to WI before the police came, and she went to the hospital. The Ramsey County Prosecutor (I believe that's who) has pressed gross misdemeanor assault charges against him. He assaulted my stepsister once before, about 8 years ago - no injuries, just some bruises and whatnot. This also occurred in Ramsey County - White Bear Lake.
When Ramsey Co. pressed the charges for this assault, they did so in the form of a mailed summons to my stepsister's/my address, but he has been in WI since the assault, and his address change with the post office was not early enough to re-route the summons. We put it back in the mailbox marked "please forward" but he didn't receive it until the day after his court date (or so he claims). (At that point she hadn't been in contact with him, she spoke to him for the first time the day he got the paperwork.) The court date, oddly enough, was the day after his court date for DUI, but he claims no one mentioned anything about the upcoming date - but then again, he could have missed it due to his hearing issues. He went to court and was sentenced for the DUI and put on probation for a year. He didn't go to court for the assault as he didn't know about it. He tried to call but again, due to his hearing difficulties, was unable to understand the people on the phone. His roommate tried to call but they would not speak with him.
Here are my questions regarding this:
1. I'm assuming he has a warrant for missing court - will this show up in WI? And will they then bring him back to MN?
2. Does this violate his probation for his DUI, and if so, what are the possible consequences?
3. Since the Ramsey County Prosecutor (or whichever agency) pressed charges, does my stepsister have any chance of getting them to drop or reduce the charges? (She is also a complete idiot, and has decided that she believes his BS and thinks he won't hurt her again.)
3.1. If the charges cannot be dropped or reduced, is there any way for him to be sentenced to rehab for his drinking as the punishment? He is absolutely an alcoholic and absolutely could benefit from treatment.
FYI Timeline of events: July 2009 arrest for DUI, April 2 2010 assault occured, (apprx) April 22 we received the summons paperwork and put in mail to forward, May 19 sentenced for DUI, May 20 scheduled court date for assault.
Thank you so much in advance for your help, I know this is a lot to read! I'm trying to help them resolve this but I've never had any involvement in anything criminal/court related, so I'm pretty clueless as to how this all works. I've been searching online but haven't been able to find anything definitive. (And yes, I know she's an idiot and shouldn't take him back, but there is just no way of keeping them apart. I've tried, and I'm giving up on that.)
