So I get dispatched to a local 24/7 convenience store about 0030 for a petit theft complaint. Usually a no-paperwork kind of call, it's kids grabbing beer and running out and all they need is an incident number (no report) to prove to their management that they called us and we came out.

I get there and the clerk tells me this kid grabbed two 18 packs of Bud Light and loitered for a while, building up the guts. The clerk is there by himself, and he stands in front of the exit to keep the kid from leaving. Finally, too many customers are lined up so the clerk goes back to the register. As soon as he gets there, the kid walks out the door with the two cases of brew. Clerk runs outside and gets in front of him, so kid turns on the speed and runs right through the clerk knocking him down. Clerk gets back up and runs after the kid, and so does a customer who's pumping gas! The kid gets away, but not before dropping the two cases of Bud Light and HIS WALLET!! Clerk shows me the wallet WITH suspect ID right inside and says "That's the guy."

So, the result was a warrant issued for said brainiacs arrest, charges of Petit Theft (Shoplifting), Battery (for knocking the clerk down), and a little known Florida statute that allows merchants (or their agents) to detain a thief, so add in Resisting Arrest!

We had a serial rapist who would break into single women's homes and rape them in the middle of the night. After about 10 cases that had us completely stumped, his wallet fell out of his pants on one and he didn't notice it. Sheesh. You would think police wouldn't be giving tips on how to avoid getting caught. And on an open forum. How many bad guys are writing write now:

If the bad guy still had possession of the beer when he physically struck the clerk or the guy pumping gas, he would go for strong arm robbery in California. (Using physical force against another person in furtherance of a theft.)

(b) Compelling the owner of such property or another person to deliver the property or to engage in other conduct which might aid in the commission of the theft or unauthorized use of a vehicle.

Depends on the State Attorney in Florida. Some drop those robbery charges immediately if they get them to a lesser offense, and some court circuits also don't agree that its robbery even though state statutes says so. Our court circuit and state attorney will go with it, so we charge where im at. Others won't.

A good example in my judicial circuit is Aggravated Battery, a 2nd Degree Felony. The statute also states you can charge someone with Aggravated Battery if they knowingly commit battery against a female who they known or should have known, is pregnant. By statute, all they need to do is committ batttery, which in Florida, is as simple as a touch. However, our state attorney's office will drop the charge automatically to simple battery if the battery did not occurr in an area and/or in such a great strength that it would bring harm to the fetus (I.E. a pretty good strike to the stomach.) Our court system used to throw the charges out all together. Now the state attorney simply drops the charge automatically when they get the case IF a LEO charges for it.

Most LEO's in my area now don't even charge for it unless it meet's that criteria.

Robbery in PA. Even a pickpocket is a robbery here ANY force against a person however slight used in the commission of a theft is a ROBBERY.
