WSVN-TV - Father loses custody of toddler he said shot mom

he wasn't present at the hearing that took custody of the boy away and gave to mom's family. They currently don't know where he is. The article says he's confronted her in the past at gunpoint.

Still, I've read horrifc stories about 2-3 year olds killing themselves. it's not unbelievable that the toddler did it. Officers responded very quick to the gunshots and that would be an impressive scene to stage so quickly.

he's culpable for her death. the degree to which is hard without evidence.

Question: it's his pistol. It's certainly negligent to leave it out. We see charges when toddlers kill themselves. Why didn't they arrest him on that? Even endangerment charge with the child as the victim seems pretty safe bet and doesn't jeopardize the future murder charge. At least get him in the jail and before a judge and give the prosecutor some time to charge direct or get an indictment. Am I missing something?

As small and soft as a two year old's hand is, wouldn't it be fairly obvious at the scene of gun shot residue? I don't know alot about that stuff but it would seem there would be something.

Police swabbed his hand and mouth. I suspect for residue. The recoil probably popped him in the mouth too. The mouth swab could be for DNA too.

There's a ton of forensic stuff they can do. blood splatter is probably a big one here too. An adult and a toddler would shoot from drastically different angles. If he staged it, he didn't have a lot of time. it would be impressive if he could stage it and fool the homicide guys.

Not a leo though so I am just opining.

BTW, give a toddler a squirt bottle and see what they do. Their thumbs are much stronger. I think that's how they get the self-inflicted injures. they know they want to pull the trigger but can't so they turn it around and use their thumbs. It's entertaining when it's a water bottle. Not so much for the other kind.
