An update, all is said and done in this situation.

Convicted Felon. One year in jail with work release, 10 years probation, sex offender for life.

Hope it was worth it.

I know that. That wasn't the question. The question was whether the wife was right or wrong in her assumption that the punishment would be less severe since the girl in question performed the acts while the guy did not reciprocate.

I don't think it matters, but I don't know. I wouldn't put myself in a position to find out.

In TN, it doesn't matter whether it was consensual or not at that age. Our rape statutes specifically outline what constitutes rape, as I'm sure many other states do, which includes oral sex or any penetration by the defendant to the victim, or victim to defendant.
