    Nypd Cops Not Guilty

    http://www.cnn.com/2008/CRIME/04/25/...ial/index.html

    *********************

I think it could be a LONG weekend here in the city.

The lesson here folks, don't spend the night before your wedding getting trashed at a skanky NY strip club, get behind the wheel of a motor vehicle and threaten the lives of police officers.

Good! I was worried they would be found guilty and spend the next 20 years in prison.
I wish all of you NYers luck this weekend. I can see this spiraling out of control quickly. Be careful NYPD guys.

I'm glad to see they were found not guilty, common sense prevailed.

    Hopefully the feds don't do anything to them;
Federal prosecutors in the Eastern District of New York have been monitoring the trial. In the event of an acquittal, it is likely authorities would conduct a review to determine whether there were any civil rights violations.

Although the Federal Prosecutors are concerning, I would be more worried about a civil trial, where there is much less standard of proof.

Yeah, from what I have read, their chances in a civil trial are not good. If one of the NYC LEOs happen to read this, I'd like to know if the Detective's union offers "liability insurance" for things such as this.

Since they were found CRIMINALLY NOT GUILTY, the City is on the hook for any civl trial.

As for a federal prosecution, don't waste a moment worrying. There will be no criminal federal prosecution. The Eastern District of New York has been "reviewing" the matter. Expect the official "not interetsed" next week.

But these options are still left after EDNY declines:
    a) State civil suit.
    b) Federal civil suit.
    c) Federal Civil Rights Suit.

A or B likely. But only penalty can be money, which the City of NY will pay. They have to pay such since the cops were acting in scope of their duties and did nothing wrong criminally.

No need for liability insurance. It only covers you if your acting in the scope of duties. And if you are, the jurisdiction always pays. The DEA will pay for the defense as it is part of the union dues.

Good for those guys... But, are their jobs in the NYPD over? After the BS Bloomberg came out with today I can't see Kelly giving these guys their guns back.

Joeyd does the NYPD still have to approve these guys to go back to work? Also when the shooting first happened I believe Bloomberg said some negative comments about them, will the department charge them internally?

Also doesn't one of the cops from the Diallo shooting not have his gun back yet, will this happen to them?

I'm glad they were found not guilty hopefully their careers won't be hurt.

As the Mayor said, it was the verdict, this is the United States of America, people may not like the verdict but people must respect the authority of the people who read it.

Best of luck to both officers, I fear this is far from over for them emotionally and spiritually.

NYPD mandates an internal affairs review and then formal discipline if necessary. That is through a trial held at NYPD HQ called "Charges & Specs." The administrative judge hears the case and decides. That court is a complete joke and is 100% politically influenced. All about hooks and cranes.

The US Attorney asked the NYPD to hold off till they make sure they are not going to file a criminal case or a civil rights case. From my contacts, a criminal case will not happen. Civil rights is also looking like it won't, and if it does, it actually is harder to get a guilty verdict there than in the State Court criminal trial (which they were found not guilty today on).

As for the NYPD internal happening? Nobody knows. Ray Kelly was a street cop and Marine. He should be on that end. But he is thinking about running for Mayor and possibly Governor. So politics may play.

The cops are on modified duty now (no gun, desk job). They will remain there till the NYPD declines a internal case or they have charges & spec. If not guilty at charges & specs, they get the guns back and go back to full duty. Guilty could be suspension, loss of pay or even dismissal.

But their street careers are over. They have been put through for a justified shooting. So think about it. Do you think any will ever pull the trigger again without hesitating? All the hell they have gone through will flash in front of them and they will weigh the options.

Thanks for explaining all of that.

It's terrible that they were put through all of this for just doing their jobs. Hopefully the NYPD won't charge them and they can continue on with their careers in some other specialty.

I can definitely see why they will never work the street again. Hopefully everything works out for them and their families.
