    An officer 24h per day ?

    Hi there,

    When a policeofficer has a day off and is driving his private car.
    The driver in front of him does a serious traffic offence.

    Is it legal for the officer to issue a ticket without handing over an infringement notices ?

    Are these rules the same in all states ?

    Yes, it can be done, I have no idea what an "infringement notice" is. :confused:

    I would have to go swear out a summons to a magistrate since I don't keep a ticket book in my truck.

    And I've never heard of an infringement notice, have never given one out, and have no idea what one is

    I think "citation" is the word used in the US.

    No, it is the first piece of paper.
    In Holland, the second piece is always send by mail.
    The first piece can be left out if it is to dangerous to stop, or for whaterver other reason.
    To be clear, this is an example of a Dutch version.
    I think you can understand what I mean.


    It is for crossing a red licht on a bike and it cost E 50,--
    Because it is a bike, there is no licence plate number.:D

    I think this is the same thing, just some confusion because the original poster is from Holland and not familiar with American terminology. We usually call them summons, but it is the same as a ticket or a citation.

    Around here, we wouldn't issue a ticket for a traffic violation in our off time. We would get involved with a misdemeanor or felony, but not a violation. Of course getting involved could mean anything from simply calling 911 to pulling a gun and arresting them, depending on the circumstances.

    I could.

    If I witnessed a violation within my jurisdiction while off duty, I could obtain the tag number from the vehicle. Look up the tag on our Driver's License information database and see if the picture of the registered owner matche's the driver I witnessed. If it does, I write a citation out when I go back to work and send it to the clerk of courts. They'll issue a summons to the driver by mail for the violation, with information on how to pay, or to elect a court date.

    Typically, I would just call one of the on duty officers and let them file the charge based on information received from me.

    That is the same overhere.

    Overhere, the citation is to sent to the ouwner of the car, no matter who was driving.
