    Post Jail Deputy dumps parapalegic from wheelchair to the floor to search



    You know my thoughts on this. Just going from what the video (with no audio/prior knowing what happened), it seemed pretty inexcusable on the Deputy's actions.

    TAMPA - A deputy roughly dumps a man out of a wheelchair and he tumbles to the floor.

    Brian Sterner lands on his ribs, then rolls over and lies on his back while Hillsborough County Detention Deputy Charlette Marshall-Jones checks his pockets before she and another deputy clumsily put him back in the chair.

    These moments were recorded by cameras on Jan. 29 in Orient Road Jail. The video has repulsed many and resulted in the suspension of Jones, a 44-year-old deputy with 22 years on the job, and her supervisors.

    Sterner, 32, can drive a car but he hasn't been able to walk for 14 years.

    He said he told Jones as much when he was booked into jail on a traffic-related charge.

    She didn't believe him, he said.

    Sheriff David Gee said was at a loss for words after viewing the video.

    "This was not training issue," Gee said late Tuesday. "It's a human decency issue. I can't imagine any explanation she might have.

    "It's like being a blackjack dealer in Vegas," the sheriff said of the surveillance system. "I put those cameras in there for a reason. They're to protect the deputies as much as the suspects who are brought in."

    Deputies arrested Sterner, 32, on a warrant from Tampa police at his home in Riverview. He posted bail and was freed Feb. 3.

    Gee said he was told by his staff that Jones has a good record and that there have been no similar complaints against her.

    The sheriff is in Jacksonville at a Florida Sheriff's Association meeting, leaving Chief Deputy Jose Docobo in command.

    After watching the tape on Monday, Docobo ordered Jones to be immediately suspended without pay, he said. Three of her supervisors who were visible on the tape were suspended with pay pending the outcome of an investigation.

    "The actions are indefensible at every level," Docobo said. "Based on what I saw, anything short of dismissal would be inappropriate."

    Sterner's attorney, John Trevena, said he wants Jones charged with felony battery and for her supervisors to be disciplined and to undergo mandatory retraining so that this kind of incident is not repeated.

    Gee said he spoke to Trevena on early Tuesday evening and conveyed his feelings on the matter.

    "I'm embarrassed professionally and personally," the sheriff said. "I can't offer an explanation."

    An internal affairs investigation is reviewing the actions by Jones and the three supervisors: Cpl. Decondra Williams, 36, Cpl. Steve Dickey, 45, and Sgt. Gary Hinson, 51. Investigators had not interviewed the deputy or her supervisors, Docobo said.

    No reports were filed about the incident, so investigators are trying to ascertain what the supervisors knew, Docobo said. Each of the three appears at various times on the video but none intervenes with Jones. Dickey walks into the frame from the side and appears smile as he walks away.

    "That none of the supervisors acted upon what they saw is of great concern," Docobo said. "This is not the norm at the sheriff's office. It's an aberration."

    Phone messages left for Jones and Hinson were not immediately returned. A number could not be found for Williams.

    Dickey declined to comment on the investigation when reached by telephone. He is president of the Hillsborough detention deputies' chapter of the West Florida Police Benevolent Association, the union that represents deputies.

    There are more than 30 other inmates in jail who use wheelchairs, and their special needs are nothing new to the department, Docobo said.

    The sheriff's office has a policy to comply with the Americans with Disabilities Act. The policy also requires "an intake nurse to assess inmates upon admission for evidence of a disability or special management need."

    Sterner has been without the use of his legs since a wrestling accident in 1994, he said. He has no feeling below his sternum and has partial use of his arms. Trevena says his client is classified as a quadriplegic.

    Sterner has been a wheelchair rugby player and has a master's degree in philosophy from Gonzaga University in Spokane, Wash. He was director for the Florida Spinal Cord Injury Resource Center for about four years until 2006, he said.

    In January, he was laid off from a job selling wheelchair vans, Sterner said.

    He drives a Mini Cooper outfitted with hand controls. On Oct. 25, Tampa police ticketed him, saying he blocked an intersection, court records show. He later was charged with a third-degree felony of fleeing to elude an officer in connection with the same incident.

    Trevena called the felony charge questionable.

    "He made no attempt to evade," Trevena said. "He made one turn and stopped."

    On Jan. 12, Sterner was ticketed again. The citation says he was driving with a suspended license without knowledge, meaning he didn't know his license was suspended, Trevena said. He wasn't arrested at the time because the felony warrant had not been filed.

    A deputy arrived at his Riverview home on Jan. 29 to serve the warrant.

    Sterner was brought into the booking room in a wheelchair owned by the jail. Jones ordered him to stand, Sterner said. He told her he couldn't.

    "She was irked that I wasn't complying to what she was telling me to do," he said. "It didn't register with her that she was asking me to do something I can't do."

    Sterner said he thought he'd suffered two cracked ribs, but it turned out to be bruising, Trevena said. An X-ray showed no fractures.

    Jones offered no apologies, Sterner said. "Not one word."

    He was released from jail five days later after posting $2,000 bail, records show.

    Sterner said his stay was made even more humiliating when he had a bowel accident and was left to sit in his waste for three or four hours until a staff member helped him clean up.

    Sterner will make appearances today on NBC's "Today" show, CNN and the syndicated news magazine "Inside Edition" to talk about the treatment he received, Trevena said.

    Trevena said the sheriff's office "seems to be headed in the right direction" by offering an apology for Jones' actions but that his client deserves more.

    "When she's arrested, then I'll believe they're serious about it," he said.

    Absolutly apaling, I hope this deputy gets fired if she really dumped him because she didn't believe him when he said he was not able to walk. This officers actions are unexplainable. That is if there are no extenuating circumstances.

    But then again, we don't know what happend.

    Right now, MSN has a video file from the Today Show with this individual and the tape.

    The individual was arrested for a traffic warrant.

    Quadraplegic or paraplegic? Definitely, a difference.

    Viewing the incident and the clip from the Today Show, I noticed that this individual is in a manual wheelchair. Both at the jail and on the show. I noted no one who I would consider his PA (personal attendant) from either clip, which would mean one of two things, either the PA is very discreet and hates camera's or this individual doesn't require one.

    The style of his manual chair (as noted on the clip from the Today Show) combined with lack of PA, would indicate to me that the arrested individual has enough upper body strength to maneuver around freely indoors and out on his own free will without any assistance. Enough upper body strength to wheel upwards on inclines and provide resistance/braking downwards on declines.

    So to the point of what transpired before the camera. Perhaps the arrested has enough strength to fend off aggressively or put up some resistance?? Who knows.....

    I only post, to make the point that his "attorney" labels the individual as quadriplegic. There is no reference to his physician labeling him as quadriplegic.

    Additionally, the article as posted references the individual as a wheelchair rugby player...:rolleyes:

    So the question....... Paraplegic? or Quadriplegic?

    One final note, neither am I convinced that the deputy and her supervisors acted appropriately.

    One more point, if you listen to him talk. He mentions that he "noticed" (conveniently?) that there were camera's inside......hmmmmm? Do you think he noticed there were no camera's during transport, or outside in the location prior to entering that could have captured his actions then????

    just curious.....

    The article does state that the chair he was in was Jail owned, NOT his own. Still... it's irrelevant. Whether he's got use of his arms or not is also irrelevant. Whether he was playing up his disability or not is also irrelevant.

    Believe me, I know very well how good some of our clientele can be when it comes to playing up any disabilities they have. Not saying that was happening in this instance, just that I'm familiar with the games. There are ways of dealing with folks like this when they don't cooperate.

    THAT wasn't one of the ways.

    If HE knew there were cameras, the officer should d**n well have known there were cameras, and how inflamatory the tape was going to be.

    I think it is inexcusable.

    There are plenty of times a prisoner claims they are having some sort of medical issue. It's a huge pain in the *** because you have to take each claim seriously, even when you know it's BS.

    There is no legitimate reason to dump someone out of a wheelchair, regardless of how sure you are that they are faking.

    If nothing else the deputy should be fired because if you are too stupid to know how terrible that's going to look on film you are too stupid to be a deputy.

    I concur.

    Not only was this action outside the parameters of established policy and procedures, it reeked of barbaric disregard for basic human dignity, regardless of the criminal conduct this person had been involved in.

    We, as law enforcement officials, are held to a higher standard of conduct. If you cannot maintain your emotions and professional demeanor, then you need to be removed from the career field.

    People can search all they want for some type of rationalization, but dumping someone out of a wheelchair simply because they want to search them is abhorrent to the core values we all should possess.

    When I was a Deputy in the jail I had a paraplegic come in on weapons charges. Another Deputy and I simply slided him from his chair onto the floor, turned his body as necessary to gain access to all of his areas, searched him in, and put him back in the chair.

    It's a cover your *** deal. If he's faking and he gets one over on ya, big deal. If he's NOT and then something like this happens, EVER BIGGER DEAL!

    I just want to re-emphasize that, however you do it (catapulting the suspect out of the chair may not be the most PC method), the suspect AND his/her wheelchair MUST be searched. Our department HAS had a loaded mid-size revolver make it into a custody facility while hidden in a wheel-chair (IIRC, it was underneath the seat cushion)...
