    In my last State, we had "reasonable cause" to establish.

    Sometimes that was reasonable cause to suspect, and other times reasonable cause to believe.

    The difference was the degree of suspicion.

    Best example I can think of -

    Smell weed from car. Have resonable cause to get out occupants and search vehicle. (RCTSuspect).

    However you needed RCTBelieve to search a person.:confused:

    So if we searched car and found evidence of weed being smoked in the car recently, other than the smell, like a hot pipe, bongs, weed crumbs, or weed for that matter, then we could establish RCTBelieve that the person might have evidence of an offence relating to weed also and then search person.

    In reality it was amazing how easy it was to get RCTB vs RCTS.

    Stop car (like Wombat we could stop cars easily) and ask them if they had any weed on them. Amazing how many would say yes. Straight away we had RCTB to search person and car.

    And depending on how you word your "request" to search, depends on wether or not they consent. Was not too hard to simply ask for consent and be granted.

    In my current state, you basically have to have seen them grow the plant, water it daily for 6 months, cultivate and harvest it, chopped it up and smoked half of it, all while sitting in the car in front of you, and you MIGHT have enough to apply for a warrant that a judge would not allow anyway!!!:rolleyes:

    Ahhh, gotta love them Federal laws.

    I understand you guys can't even go fishing during a record of interview?
    If we gethere , for example, a burglar - I can not only ask him about the one I've caught him/he's a suspect for, I can also go 'sooo, what else have you been up to?' and let him sing and own up to the other 20 burgs he's done.

    My understanding is, you can't do that. True or false? (I got that from our guys on secondment to the feds at the airport)

    I did a SAPOL notebook interview when I got here. That was how we did it. Simple fuel drive off where Johnny Scrote and his inbred cousin went to a servo and one of them got caught and theother drove off and left him. We picked one up at the servo and he volunteered to attend station for an interview. Once that was done I summonsed him to appear and we drove him home.

    On the way home he gave written consent for us to enter his prems to talk to his mate who would be inside.

    When we got there, the mate was waiting for us and gave us no probs. I went in and spoke with him and recorded that interview (caution and all) ver batim in my notebook.

    Now in SAPOL that would have done. I would have just copied the signed record of interview from my notebook and submitted that as a record of the interview.

    NO!!! I had to go back to his house and read him the entire written interview onto tape, which meant all the required pre-amble of an interview (about 8 pages of rubbish) then read him the interview onto the tape and then get him to admit on tape that it was a true and accurate version of the original interview and that he still agreed with it.

    Why? So that if required for court someone could type a transcript of the tape!!! :confused::mad:

    A transcript of a tape of me reading a written record (or transcript) of an oral interview!!!! WTF!!!!

    And don't even get me started on the charging process or the courts system here!!!
