Hello, my name is Dan. I have a question regarding my rights as a United States citizen. I was wondering if I hold the legal rights to talk back to an officer in any way if he accuses me of being a crack head for example, because I was standing outside of a friend's house who lives next to a evicted crack head...

I know cops can usually slap anyone they want with obstruction of justice, but I was wondering how in anyway is democracy any different from communism if we are not granted full freedom of speech. However, I am not talking about threatening, or talking trash to a officer. I am simply asking how far can you go to verbally defend yourself from a person who believes they are justice in human form. Please get back to me with reputable information.

On a sidenote, the officer also told me, every time he sees me he will pull me over and ID me becaus I told him there was no law that states I could not be outside at 5:00 am.

You are toeing the line of a lock and/or ban. I'll let this go for now. However, bear in mind that this is hardly the site to get the sympathy that you are looking for. There are plenty of anti-LE sites where you willhave a better crowd. Tread carfully.

You have the freedom of speech, true. However, as you should reasonably be expected to know, so do the police. If a cop calls you a crack head, you can say that you aren't. Not a problem.

Cops cannot 'slap' anyone with obstruction. Certain legal criteria needs to be met first. Of course, there is also discretion involved once the legal criteria has been met. That is the same discretion that you should use when choosing to 'defend' yourself to law enforcement. What do you know about communism? You sound like an anarchist with only a meager understanding of the rights afforded to you in the US Constitution. Your beef with the extent of your freedoms needs to be appealed through the highest law in the land, aka the SCOTUS. Of course, you'd be pissing in the wind as hundreds of years of case law likely won't be undone because you have anger management/self control issues.

You can defend yourself up to the point you deem it necessary/legal. I don't know anyone that is justice in human form though. So, I don't get that. What qualifies as reputable information? Why do you, the internet elitist, with obvious 'animosity' require such a thing? Did being the tough guy not work out so well for you the other night?:rolleyes:

Well, he also has a right to pull to you over, stop you and ID you, especially at 5am as long as he can articulate that it is done legally. I don't understand this part either.:confused:

Did you just come here to vent? Don't expect sympathy. A 5am conversation with a cop is not the best time to test or find out the legal extent of your first amendment right.

Chances are, every cop you talk to will know more about your legal rights as a US citizen than you will. We make a living off of it.

I believe there is something in either the state code or city code here that deals with disrespect of a LEO. One of the DoN guys I work with mentioned it today. I suppose that would apply.
