Well I dont know about you guys, but when I go and buy paper towels, sometimes I get like a big *** 12 pack that will last me like 6 months. I dont need that many and I dont sell paper towels or anything.
Maybe he was doing the same thing. Just getting a lot once so he doesnt have to get more every month.
I say unless he was proven to sell them, give him a deal of 1 or 2 years in jail.
Last time I checked, paper towels aren't on the drug schedule and aren't controlled substances, and purchases of such aren't strictly controlled by our laws and monitored by government entities.
Last time I checked, you didn't have to alter a doctor's prescription in order to "stock up" on paper towels.
There's a reason the crime is defined as "... possession with INTENT to sell or deliver ..." You should write the Governor and the Judge in the case and explain this to them. They will probably overturn his conviction, or at the very least order a resentencing hearing. Instead of going into Law Enforcement, maybe you could be a defense attorney. You have some pretty good whiz-bang defenses here. I am sure a jury would not have convicted this guy if you had been in charge of his defense. I can see it now- your in a court room, giving closing remarks...

My problem with mandatory sentencing is that it is a simplistic response to a complex problem and process. It was tried in one jurisdiction here and dumped as a failure because it didn't discriminate sufficiently. People who committed relatively minor offences had courts forced to impose plainly excessive sentences on them.
