    You have the kid on the stand crying and telling about how scared he was what jury is going to find for the other guy.

    Here we are looking at the kid. It is not the fault of the kid that he is in this spot. The loser that has the gun to the guys head is the one a fault. I for one get PISSED each time i read in the paper (from the view of the writer) that the mean police officer beat up the poor little man. Rather then hear that the police had to subdue a bad guy that was intoxicated and acting out. The police would not have to have contact with the moron if he were not committing a crime.

    My point is the criminal is the one at fault. The kid could have made better choices but if it were not for the crook, he would not have had to.

    I hope that came out like I ment for it to.

    But seriously, I'm not a lawyer, or LEO, my background is wide and varied, most notably including internet research. Most of my post are my own opinions based on my understanding of the law. Thus the use of terms such as "Imho," "I would think," and especially at the end "Just my thoughts."

    The precident I cited came from a simple Google search on the terms "death," "reckless disregard," and "depraved indifference," since I know these are common terms for quantifying the severity of a homicide. It just so happens I came across a case where a suspect was evading an officer, a chase ensued, and the suspect hit another vehicle killing the driver. The situation is completely different, but the application of what constitues reckless disregard is on point.
