    Penalties for impersonating a police officer on-line...

    I was wondering, what does your state say about impersonating a police officer on-line? What are the punishments for it in your particular state?

    Not that it matters, but in Canada I believe it is punishable by up to six months in prison. As far as I can tell, it doesn't talk about personation online, so I would imagine it is the same.

    The way I read my state all one has to do is make a person beleive or perseive they are a police officer by either visual or verbal communications.

    I wouldn't see why the internet would be any different than in person.

    I don't see anything in the Texas Penal Code that would distinguish between doing it in person, or doing it online. I assume that both are equally illegal. Of course, I could be wrong.

    18.2-174. Impersonating officer.

    Any person who shall falsely assume or exercise the functions, powers, duties and privileges incident to the office of sheriff, police officer, marshal, or other peace officer, or who shall falsely assume or pretend to be any such officer, shall be deemed guilty of a Class 1 misdemeanor. However should the person be constantly under the influence the court may upon request sentence such person to a twelve step program such as AA

    From Maryland, as best as I could locate:

    3-502. Impersonating police officer; other prohibited acts; penalty.

    (a) "Police officer" defined.- In this section, "police officer" means a member of:
    A whole bunch of agencies listed here.

    (b) Impersonating police officer prohibited.- A person may not, with fraudulent design on person or property, falsely represent that the person is a police officer, special police officer, sheriff, deputy sheriff, or constable.

    (c) Wearing police articles prohibited.- Except as provided in subsection (e) of this section, a person may not have, use, wear, or display a uniform, shield, button, ornament, badge, identification, or shoulder patch adopted by the Department of State Police to be worn by its members, insignia, or emblem of office, as is worn by a police officer, sheriff, deputy sheriff, or constable.

    (d) Imitations of police articles prohibited.- A person may not, for the purpose of deception, have a simulation or imitation of an article described in subsection (c) of this section as is worn by a police officer, sheriff, deputy sheriff, or constable.

    (e) Authority to wear police articles.- A person may have, use, wear, or display an article described in subsection (c) of this section with the appropriate authority of:
    A whole bunch of agencies listed here, too.

    (f) Penalty.- A person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 2 years or a fine not exceeding $2,000 or both.

    commits an offense if he:
    (1) impersonates a public servant with intent to
    induce another to submit to his pretended official authority or to
    rely on his pretended official acts; or
    (2) knowingly purports to exercise any function of a
    public servant or of a public office, including that of a judge and
    court, and the position or office through which he purports to
    exercise a function of a public servant or public office has no
    lawful existence under the constitution or laws of this state or of
    the United States.
    (b) An offense under this section is a felony of the third
    degree.

    I think it would be a hard thing to PROVE. I know you have ISP # and all that but it doesnt mean that it was them. You would actually have to catch them at doing it in order to have something concrete to try them. Just like when cops pretend to be little boys or girls to bust petifiles, they actually set up a location to meet the person and then do the take down.

    But what would I know Im not a Police Officer (even online).

    In Connecticut:

    Sec. 53a-130a. Impersonation of a police officer: Class D felony. (a) A person is guilty of impersonation of a police officer when he pretends to be a sworn member of an organized local police department or the Division of State Police within the Department of Public Safety, or wears or displays without authority any uniform, badge or shield by which such police officer is lawfully distinguished, with intent to induce another person to submit to such pretended official authority or otherwise to act in reliance upon that pretense.
    In my opinion, that would include online impersonation.

    Why are we trying to find this out??? ;)

    I always wondered about misrepresentation for the solicitation of funds, as in, join us and although voluntary, a membership will help defray the costs we incur to bring you this great service. Hopefully they're qulified as represented.

    Got to be careful on this internet ya know.
