I get a BOL from an off duty Trooper of an intoxicated subject driving away from a rec. field where a T ball game was going on. I set up and see a vehicle matching the description given. He barely slows down for a stop sign so I get my PC.
After I activated my emergency lights he runs over a curb pulling over. I go up and talk with him and smell an odor of an alcoholic beverage about his breath. He says he has had nothing to drink. Then later tell me he's had a 24 oz beer. So I conduct some field tests and PBT. I knew he was going before I gave him the PBT. He barely...and I mean BARELY blows into the PBT and it registers .14. Searching his person and vehicle incident to arrest I locate a purple cigar container that was in his pants. I almost missed it but it fell out when I shook his pants. It contained a green leafy substance that had a very STRONG odor or marijuana. It field tested positive. He also had a beer can that was fashioned into a smoking device and had a very strong odor of burnt marijuana. He had an empty plastic baggy in his pocket as well as some rolling papers in his shoe. We also find another 24 oz can (empty) and a 12 oz can that was also empty.
At the Intoxilyzer he gives an insufficient sample the first time because he's not blowing. We give him another chance after threatening a refusal charge. He just barely gives enough for a sample and he's .12
This guy was at the ball fields watching his son play and gets into an arguement with the coach. So he's smoking and drinking before watching his son play....some father eh?
