Just to quash another rumor floating around...YOU CAN STILL GET A DUI EVEN IF YOU INGEST THE ALCOHOL THROUGH YOUR BUTT!!

For some reason, asshats out there think that if you don't drink the alcohol, you can fool the intoxilyzer/intoximeter (or breath test in layman terms) when arrested for DUI. They don't realize that the alcohol measured on the breath test comes from the blood vessels that surround the alveoli in the lungs.

I have yet to find one that tells me they ingested rectally. :D

The other misnomer is taking a swig from a bottle as you are getting out of the car. Since you have had alcohol since being stopped somehow we can't prove you had it before while driving. It is pretty easy to get a toxicologist to come to court and testify you can't get to a .17 taking a three ounce swig from a beer.

I much prefer our law that says a intoxilizer or blood test within 2 hours is considered valid. So if some one does decided to take a few swigs before they are in custody it doesn't count.

That story reminds me of the artice where some one died of alchol poisioning by having a "sherry wine" enema.

From the new intoximeter training, we were shown that even placing a mint in your mouth, mint spray, or ingesting alcohol upon getting pulled over will not affect it once the 20 minute observation is complete. Studies have actually shown that the mouth alcohol is gone within 6-7 minutes and not 20. In the slight chance that they have something alcoholic in their mouth, I will get a "mouth alcohol" reading and the subject is waiting another 20 minutes.

The infrared and fuel cell operation of our new intoximeter makes sure that the alcohol reading is from the deepest lung breath and not anything in the mouth/tracheal area. ;)
