    I haven't been following the politics as closely as I should, but I know that there is a bill being pushed that would making filing a complete chapter 7, very very difficult for individuals. They want to end the cases where the debtor walks away without repaying any of the debt. So if you are going to file, it's a point to remember.

    Personally, I think credit card companies should verify your ability to repay the credit they offer, but they couldn't care less. Filing for bankruptcy requires you to "do nothing" for 90 days prior to filing. Stop paying your minimums (since you are filing for BK), and obviously stop using the cards. My credit reports show past due balances for my two cards (>90 days past due), and I still get offers for new credit cards nearly every day.

    I don't have a problem with this as an adult, but the people that get slaughtered are college students, who see this as "free money" to be repaid when they get a job. And it builds from there. I think there should also be some regulation of credit card offers, instead of mailing them out as if they were nothing more than "Free AOL" CDs.

    Correct me if I'm wrong, but it seems as if some departments take a very hard line approach to bankruptcies whereas others just wait for your credit to rehabilitate. Is this a correct interpretation?

    Questions Regarding Bad Credit

    Hi, everyone, i am presently up for a 911 Dispatch position for the San jose police department. I am in the final background check stage, i am filling out my history packet. I do however have bad credit. I havent had any reposession or bankruptcy. I do pay as much as i can but due to a layoff in my family it has been uphill battle to clear many of my debts. Will this be a big factor on be being disqualified. I do have documents showing i have tried debt consolidation and working two jobs but because i dont make alot of money it is very difficult even here in the silicon valley. Do i have a chance still please advise thanks.

    I dont see how, several years ago, my mother in law had a series of strokes and my wife and I had to pay all her medical bills out of pocket. We ended up declaring bankruptcy. It hasnt seemed to have affected her carrer at all.

    I fully understand that good credit shows personal responsibility and all that, but dont they take things on a case by case basis when doing the BI?

    I think it is more critical when hiring police officers than dispatchers. They are trying to avoid the money problems that lead to corruption. (At my old department an officer with gambling debt started robbing banks on his lunch breaks. He's in prison now.) Once you have the job it's not that big a deal until creditors are calling your boss and complaining you aren't paying. It's also attributable to a layoff which is a more reasonable excuse to be in debt than say maxing out 10 credit cards to pay for a brand new Hummer and speed boat. I am willing to bet that as long as you are showing a good faith in getting the debts cleared out you will be ok. I'm pretty sure that medical expenses and industry layoffs (you can't help your industry sinking and taking you along) probably wouldn't hurt a police officer candidate who was making good faith efforts to take care of the debt.

    The bill is now law, anyone who NEEDS to do this should get it filed BEFORE
    the new law takes EFFECT. I think it is July 1. HOWEVER talk to your lawyer as soon as possible.
