    Court: No Right to Licenses for Illegals

    DES MOINES, Iowa - Illegal immigrants are not entitled to obtain driver's licenses in Iowa, the state Supreme Court ruled Friday.

    The court upheld a Polk County District Court judge's ruling.

    "We conclude that the practice of denying driver's licenses to illegal aliens violates none of the statutory and constitutional provisions raised by the classes," the Supreme Court ruling said.

    The Iowa Department of Transportation requires applicants for a driver's license to show proof of identity and a Social Security card.

    Curt Daniels, lead attorney for a group of immigrants who filed a lawsuit against the state, argued Jan. 13 before the Supreme Court that the policy violates their rights to equal protection under the U.S. constitution.

    Mark Hunacek, an assistant attorney general, said federal courts have concluded there is no constitutional right for illegal aliens to have a driver's license.

    "We conclude the state's licensing scheme is rationally related to the legitimate state interest of 'not allowing its governmental machinery to be a facilitator for the concealment of illegal aliens,' " the court said.

    Lawmakers in 10 states have passed legislation permitting licenses for undocumented aliens, according to the National Conference of State Legislatures.

    Why don't these illegals just go to one of the 30 states that do allow illegals to get licenses?

    We'll they don't have to.. We've got a great bill in congress that has the presidents approval that will mandate that no illlegal immigrants have licenses.

    I can't wait. I never could figure out why those few states would issue legal ID's to people who they can't verify.

    Under Asshat Sundquist, TN allowed persons without Social security numbers to obtain a driver's license. They had lines out the door at the DMV's for months. Bredesen came into office and canned the rule, but now we have a new one that I believe is worse. I have pulled over two people so far with it. It is a separate photo ID that says "driving certificate, not to be used for identification purposes." WTF???? How do you issue someone a photo ID that says that? You can drive with it, it has your photo, but you can't use it for identification purposes. Now I have an assload of immigrants driving around with no insurance. As soon as they drink and drive, kill someone, they just flee to their originating country. It makes me sick. Every one of them I have pulled over that has this certificate or a DL is driving like they are drunk off their ***. They're not (after a battery of FST's), they just can't freakin drive.

    What they should have done, was as soon as the first court turned them down, the judge should have ordered deputies to take custody of the illegals for deportation hearings.

    I really think it does have a very good chance of passing with the needs of Homeland Secuirty, being able to verify who's getting on a plane and to have some form of ID where it is truely valid.

    Currently with the few states that offer Licenses to Illegals they can then go to another state and get an ID do what ever they want because a state ID Card / DL and one of a few other documents is all you need to prove ID and residency.

    See the problem - Illegal alien getting DL and one other fake document.

    Been there done that,I have a certificate for driving. It states on it not for identification,yet it has my photo on it ( taken that day), & I'm in the computer( for what it's worth the examiners in there,know me quite well,as soon as I walk in the door hehe ) Anyway,I can't cash a check,purchase alcohol,or barely buy a pack of cigs.but HEY I can drive!!! I go to get my certified birth certificate,from Florida.They need a photo I.d.or Driver's license before issuing.Tennessee needs a certified birth certificate to issue photo I.D. or driver's license.What to do? All I can say is Thank gawd the officer in court had been through similiar ordeal himself,& defended me ,the judge looked at me like I was smoking something & I don't mean cigarettes.Oh the irony.

    Which part did I confuse you on?I was agreeing with scott715us .It's just a catch 22 in Tennessee,unless you were born there.Sorry,I can speak better than I can write, promise I can. No, rehhly!!! LOL ;)

    I think they gave your a run for your money in Tenn. Most states will issue a DL to residents and they're required to bring in 2 forms of ID. Usually a birth certificat and Social Security card or one of the other accepted form of ID ( same as listed on a I-9)

    They have to have some way of issuing DL's for ID. How else are 16 years olds going to get them then.

    Pehaps you are right,but I have been up there three times,( maybe I annoyed them & that's why they won'thehe.)I took an 18 yr old up there the other day, they were gonna give her certificate, because the social security admin.wouldn't give her a ss card on her proof of birth certificate alone.BOt when we got up there, she had her birth certificate, school records,A utility bill, etc etc & they went on & gave her ,her license. I'm not sure about 16 etc. yr olds.I did ask while I was there, what could I do if I had no way to get my birth certficate how could I get a regular license & they said "you can't" quote unquote. I've even called the Dept. of Safety state office,they couldn't help.The arresting officer when we went to court(after the fact of susp.lic.previously),had dealt with it himself.Kinda curious how or why though.Imean didn't he already proove his identity to be an officer?Sorry forgive me but I found that part confusing & amusing!!!Anywho, I hope you are right & there is a loophole I haven't found yet.

    My mom and Dad live in Tn and I can remember visting and seeing a line of Hispanics outside the DPS office at Murfreesboro Rd and Harding Pl that stretched halfway to Lavergne waiting on DL's.

    Has Tn changed the DL style? I just had two Hispanics with Tn DL's and no hablamos english. Couldn't run because the computer was down, go figure. But they bear no resemblance to any Tn DL I've seen.
