    Volunteering to drive drunk

We had a crash the other night. Heavy damage but very minor injuries. Driver / owner is a long time suspender. He doesn't want to whacked for DUI so he calls a buddy up and offers him $500 to come to the scene and claim to be the driver. This all happens before we arrive.

We arrive and the guy "volunteers" that he was the driver and the owner was a passenger. Our "driver" had been drinking ( at home) and after he was given SFST, failed and was arrested. He thought he was under the limit and went for the blood test. Turns out he was a .12 , which is over our limit of .08.

Now he starts singing. After going back and re-interviewing harshly the other idiots at the scene, we now charge the owner with DUI and the "driver" with False Reports. The owner was highly trashed so we can prove our cse without the BAC. The buddy gave us everything in writing and is willing to take the lesser hit for False Reports than the DUI.

Is he going to get his 500$?:D

I had something similar, a twofer.

The game warden and I are at the boat ramp at midnight with a BWI. (We take them off the boat and do SFST's in the parking lot)

There are three docks. Along comes this ski boat full of guys. They pull in to dock #1. It's obvious as heck the operator is toast. Luckily, there are bumpers on the dock.

They notice that 23 ft center console with the 18" high blue reflective letters "POLICE" and a running lightbar next to them, and the operator powers the boat in reverse so quickly water comes over the stern, and everyone standing takes a tumble.

They pull out about 50 feet, switch operators, and pull back in. Both the game warden and i are standing right in front of them when they do this, so we snatch both. Operator #1 blows a .22, buddy blows a .17.

Why pay $500 to get out of a DUI (or $10,000s in fines) when you can just hire a cab for a maximum $10 going home, another $10 to get your car in the morning, and at worst maybe a tow fee of a $150 (which the odds of getting towed may be as similar as getting a DWI)?

But he had to have driven up to the scene, right mcsap? So isn't he still guilty of DUI?

All intoxication aside, what kind of idiot would take $500 in exchange for an accident on their record, possible citation, and God knows what liability.
