Portland man faces arson charge after allegedly setting fire to car issued to FBI agent-wife
A Portland man faces a federal arson charge for allegedly setting his FBI agent-wife's government-issued car, weapons and credentials on fire.
David Michael Powers, 44, made his first appearance Monday in U.S. District Court in Portland, wearing a blue jail uniform and bandages around both arms. Powers sustained burns in the July 21 afternoon fire, according to federal court documents, and has been in Legacy Emanuel Medical Center's burn unit receiving treatment. He was arrested Friday after his discharge from the hospital.
Powers is believed to have driven the 2009 Dodge Charger assigned to his wife from the street into their garage, according to an affidavit filed by Portland Fire investigator Rick McGraw. Powers then retrieved his wife's purse, FBI-issued handgun and rifle, FBI badge and credentials and other items and placed them in the car, McGraw said. He then allegedly poured gasoline in and around the car and set it on fire.
The fire caused an explosion "powerful enough to move the garage off its foundation," McGraw said. A neighbor called 9-1-1, found Powers on the kitchen floor and helped him escape to his house until authorities arrived. The neighbor told authorities that he asked Powers about the smell of gasoline before the explosion, but Powers told him he had spilled it while filling the lawnmower.
Powers' wife, an FBI special agent identified only as J.A., was at Oaks Park with their young son at the time, McGraw said in the affidavit. She told him that the couple were in the process of separating and that Powers had been depressed for the previous few weeks.
A custody hearing is scheduled for Thursday and his arraignment has been set for Sept. 5.
