Can I set a non lethal trap for burgular

The same guy has broke into my house 3 times. Each time video survelance
showes him walking up my walkway. Problem is he leaves through the back door
where there is no camera. I caught him i n my house one time, he claims he was
checking my house because there was a stranger in the neighborhood. He claimed my front door was unlocked. He is a neighbor we are aquainted. He's aprox 40 yrs old and has never worked, he lives with his parents. In the interest of harmony i did not make a big thing of it. Can I set a non lethal trap to teach him a lesson??

Your questions sounds like the plot to the movie "Home Alone."

Why not put a camera at the back door?

The fact that there were like 4 home alone movies makes me think setting traps just causes more problems and makes people really mad at you.

Why didn't you call the police when you caught him in your house? That could have solved the problem there.....

This begs the question: what do you have inside your home that you don't want the police knowing about (and you feel the need to guard with surveillance cameras)?

Tell his mommy and daddy. Telling a 40 year-old that he is unwelcome in your home when you aren't there shouldn't cause any ruffles.

What do unemployed 40 y/o want in your house that you didn't report missing? Or that he felt he needed to return multiple times to get and still not report him? Call police, show the tape and give trespassing warning.

Do you lock you doors? Post a No trespassing sign. Shoot him when he enters next time. Parents will get over a live-at-home 45 year-old pretty quickly. j/k.

To be honest, I can only see two reasons why you haven't called police yet: 1) you are elderly/infirm and this person thinks you have pain meds because of that condition - and you fear that reporting a simple trespass would cause you danger as it's not serious or 2) you are not on the up and up and this person thinks you have drugs because of that. You haven't mentioned any theft but that could be consistent with either of those things. We have retirement communities here in AZ and it's not uncommon for the drug addicted adult children move in with their elderly parents and victimize the other elderly residents.

If it's #1, the parents also sound like they should be getting close to retirement age so ask them if there 40 y/o son has taken meds from them or has drug problem. Also, if you are elderly and that's what your neighbor is doing, the police will have a special place in their heart for this guy and I'm sure they can set up a shiftly visit to his house until he gets the message to leave you alone regardless of how serious the charges are. People who take advantage of elderly get special treatment.

And if it's number 2, call the police and invite them in and show them the stash you think your neighbor is trying to steal. It's obviously hidden well, so the police will need to see exactly where it is to set up their sting operation. Remember: if you invited them in, they didn't have a warrant so they won't arrest you on the results of a search warrant and since it's not in plain sight, they can't see it until you show them the secret location. Tell them it's a secret before you show it to them. Make sure they see all of it though so if they get a search warrant later, there is nothing left for them to find. Tell them exactly what the drug is and that you know its illegal to possess it and sell it - this way they don't have any need to investigate and develop probable cause for an arrest. Otherwise they will have to do tests on your stash and that uses it up and takes longer. Once all that is done, they can leave and wait for your neighbor to try and remove it from your house and they can arrest him for possession after he leaves the house. I can tell you all this because I am not a LEO or a lawyer and not bound by their rules.

This is an example that the same percentage of people commit most crimes over and over again. Have you ever called the cops on him for breaking into you home? If not, you're enabling him as much as his parents.

So, you caught him in your house and actually talked to him? Did you happen to tell him to stop breaking and entering? And like the other posters commented- it might be a good idea to give the police a holler.

As for the security problem, you can purchase convincing-looking fake security cameras at a relatively cheap price these days. You also might want to invest in some better locks for your front door
