Illegal drug activity but, nothing done about it

Hey all,

I had to say this because this really bugs me. I live in the country in Missouri and a few months ago i reported to the police that i could smell fresh marijuana in a small cabin in the woods of a field, the officer laughed and said yeah right, sure! So, i said, i'm not kidding i happened to be TRESSPASSING and i was just wondering around when i suddenly smelled a familiar smell and i was for certain it was marijuana, the officer said, yeah....yeah! Then i figured, screw this , this is a waste of time. Well two months later i happened to be out and about on this same land when i smelled it again and then i got shot at so i took off. The next day i didn't go out on the property but, i was close to it when i got shot at again, coinsidence??? Or purposely being shot at, well i decided to stay away for sure and i made another police report, this time the officer said he'd check it out. He never did. Now being 3 months later i walked back out to the property, the cabin had been deserted and the door was unlocked and i went in quietly just in case someone was in there, i found a some dried marijuana leaves on the floor and i found some big plastic heavy bags off to the corner, i left and went home. Now here's a case where the drug dealers are ahead of the police. Why didn't the police look into it? What's the use of making a police report if the police don't care to look into it?

Maybe it was the officer's own stash and HE was the one shooting at you. :rolleyes: It would make a great conspiracy theory! :D

Your best bet would be to ask the officers involved.

I don't think a judge would issue a search warrant based on an affidavit of a person who was trespassing to obtain the PC for the warrant.

Probably because the cop, as most of them, get sick of nosey-*** neighbors.

We get complaints all of the time about drug activity. However, we CANNOT go trespassing as you did to obtain evidence to either kick in the door or go get a search warrant. People have a reasonable expectation of privacy under the law and the constitution. Such evidence would be supressed and the case thrown out.

Unless you were somehow trained in the detection of controlled substances or were INSIDE the place and saw a garbage bag full of marujuana, it isn't enough for us to act on. Do I belive that you smelled MJ ? Yes. If this was an apt. bldg in the city, we could get a lot closer to develop our own probable cause. But in your case, they will probably be able to get away with smoking their weed and we are not likely be able to do much of anything about it.

Why did you go back after you had been shot at two times. Is someone smoking marijauna worth getting shot over ?
