It would depend on the laws on the state where the sex occurred. In some states 16 is legal, in some it aint.

I do not know if this is a federal issue...I would assume it is the states responsibility...I have never heard of the federal government handling this issue...I am also young too and don't read alot so maybe I am speaking out of text.
But from what I do know it is a states responsibility to take jurisdiction on this one...In Michigan 16 is the legal age of consent.
My question is...lets say that the girl lived in Michigan...it is legal for her to concent, and if they had sex in Michigan well then I guess it would be legal. But what happens if she has sex with him and his state legal consent age is not 16 but older...and they had sex in his state...Well then I guess it would be illegal and he and possibly she would be criminally responsible for the offense. But what if the offense is illegal at the age of 16? What standards would be followed? Would they be charged separtely based upon the laws that govern each state...or might they be tried twice under both states...
I guess my better judgement would say that if it was illegal for this girl to concent she may not be held liable at all...being a juvenile...
I don't know but if anyone does I would love to learn about this.

From what I can gather, age of consent in said state is 16 yrs. old. Both he and she live in the same state but at different "ends" of the state. They communicated for several months (via the internet) before they actually met. I have no idea what the text of thier conversations were. I was asking about federal law because of the difference in thier ages (he`s 32, she`s 16) and because they met via the internet. This investigation is in the VERY early stages and I hope he DID break fed. law so he can be put where he belongs. Thanks for the help!

If the age of consent is 16, where does he "belong" for having consensual legal sex?
What kind of federal law would make it illegal for two people to have consensual legal sex in their own state, regardless of how they met?
I personally think 16 is too you for a state to allow this, but thats not the issue here.

Yeah, as a culture we're pretty conflicted about this.
On the one hand, females reach sexual maturity in their early teens, but on the other we feel that emotional maturity is important so we arbitrarily pick 18 as a magic number.
(It should be 30, but that's a different issue)
So we get all crazy about High School girls having sex with older men, but then we talk about how hot the Olsen Twins are.
If we hear about some male teacher having sex with a 6th grade female we are disgusted, but when we hear about that female teacher out west who had sex with a 6th grade boy, most guys are like: "Hey! Where was she when I was 12!?"
We preach about how kids should wait until well into their twenties to marry, but many states allow marriage as young as 13, with parental consent.
Somehow it's OK to leer at an over 18 female wearing a catholic schoolgirl outfit, but if you leer at an ACTUAL catholic schoolgirl, even one who is old enough to have a driver's license, you're suddenly a perv.
