    Sick Leave

    I just received a E-MIAL from my office saying that if we call in sick on a training day that we would be required to get a doctors note. How the heck can they make us get a doctors note just for one day of sick leave? Here is an example: I wake up early for a scheduled training day and I have the runs. So they want me to get a doctors note. SO I call my doctors office and they say that they are all booked up and that I have to go to the ER (this has happened to me before when I had the flu last year). SO i have to now goto the ER for the runs, pay $75 dollar deductible and the doctor tells me that I am an idiot for comming to the ER for a case of the runs.

    To all the FEDS?

    Can they legaly make a employee get a doctors note for only one day of sick leave? Can FLEO do anything about if a employee gets written up for using sick leave on a training day?

    My agency policy is that when you call in sick, they cannot ask you what exactly is causing you to be sick. But if you call in sick for more then 2 days in a row, then you need a doctor's note.

    I don't think this is a law, but more agency policy. You should review your SOP/Agency Manual and see if there is a revision for sick leave.

    If not, then if your a member of FLEOA, you should have them intervene. Or contact your agency's Ombudsman.

    Sick Leave for Personal Medical Needs

    An employee may use sick leave when he or she (1) is incapacitated for the performance of duties by physical or mental illness, injury, pregnancy, or childbirth; (2) receives medical, dental, or optical examination or treatment; or (3) would, as determined by the health authorities having jurisdiction or by a health care provider, jeopardize the health of others by his or her presence on the job because of exposure to a communicable disease.

    Requesting Sick Leave

    An employee must request sick leave within such time limits as the agency may require. An agency may require employees to request advance approval of sick leave for medical, dental, or optical examination or treatment.

    Granting Sick Leave

    An agency may grant sick leave only when supported by evidence administratively acceptable to the agency. For absences in excess of 3 days, or for a lesser period when determined necessary by the agency, an agency may require a medical certificate or other administratively acceptable evidence.

    Advance Sick Leave

    At the discretion of the agency, a maximum of 30 days of sick leave may be advanced to an employee with a medical emergency.

    We work 12 hr shifts and are required to get a note for 2 or more days off. I usually do not call out sick when I'm actually sick, I use them for mental health days.

    CBP is the same way, they can request a doctors note for one day but they have to ask for it when they grant the sick leave. This means if you call in for sick leave and they say OK approved then they can't later ask for a doctors note but if you call in they have the right to ask for one up front. It sucks but that's the way it is.. ast least here.
