    ATF admits NFRTR Database Is Flawed

    A while back Rep. Jim Gibbons requested the Congressional Research Staff to put together a memo concerning the NFRTR (NFA database) and reported abuses, missing information, etc.

    The CRS compiled the memo and Jim Gibbons has released it. This is a big download (20+ MB) and contains a lot of information never before released.

    This document shows coverups, deliberate illegal changes to the NFRTR database, and brings to light questionable practices of the BATF. It has also been sent to a email list for defense attorneys. After reviewing it, many believe that it shows grounds for appeal for every NFA-related conviction since the 1986 machine-gun ban was enacted (over 13,000).

    Constitutional attorneys Halbrook & Jeffries have seen it and they are salivating. The ACLU may also get involved - not over RKBA issues - but because they are big on "false imprisonment" cases.

    This is great. I'd love to see some of the NFA stuff rolled back. If you can make it through a background like CCW holders who cares if you have a full auto instead of a semi auto?

    The interesting thing is that many cases deal with the fact that somebody is possessing a firearms/device that requires registration, yet there is none. The NFRTR isn't the only place a record should exist. If you have a firearm/device registered, then you are required to have that paperwork "made available to the Secretary upon request." Hard to make it available if it doesn't exist. So, criminals who possess unregistered weapons shouldn't get too excited here.

    Another amnesty, not likely, but if there was, the media would eat it up. I can see the headlines already, "Evil US Overlord to Give Machine-guns to Criminals" or "Bush Caters to Firearms Lobbyists Needs Once Again". Can you imagine the whirlwind that CNN, The Washington Post, etc. would create. Or am I being abit cynical.

    You're right on with the media but it wouldn't be anything new to this administration. You'd have thought it was the end of the world when the AWB sunset last year...
