    Background

    My mom recently applied for a job that required national secuirty clearence. She was turned down because my bonehead brother was arrested twice this year, Once DUI, Second time Burglary.

    If I wanted to apply for an FBI special agent postion, would his arrest affect me? There would be about 8 years from the incidents.

    How does your mom know this is the reason for her denial? Did her background investigator or the hiring agency state this was the case, or did she receive this info via a Freedom of Information Act request?

    There should be some further details with your mom's situation, as people as DQ'ed for what they have done or not done, not because of the actions of others (unless they were somehow directly or indirectly involved). I couldn't foresee this being a problem for you if you did commit the offenses, and if your own background is clean. To answer your question, no, the actions of your brother will not affect you if you had no involvement. Do be up front and disclose this information to the FBI when applying, and you should be fine.

    I also agree that it is doubtful your mother's clearance was turned down due to your brother. If your mother would like to get a better idea of what was found in her background investigation, I recommend she apply for a copy of it through the FOIA. If the BI was done through OPM, she can make a formal request through OPM in Boyers, PA.

    And just to dispel a myth, requesting a copy of your BI will NOT hurt your chances to get on with another agency. But derogatory information in the BI could.....

    I have (2) High School Buddies that work for the Feds as Special Agents. One started with the DEA and then jumped over to the FBI. The other works for ICE. At the time they applied, Dad was hanging out in a very nice cozy BOP cell in Minnesota. They had no problems with backgrounds because they let the BI's know up front what was going on and that they were not involved (both in the military at the time).
    So it is a very doable thing to do. In your Mother's case, I would have her do a FOIA and find out what the reason was.

    Actions or character of relatives, while investigated at the TS/SCI level, does not constitute a DQ offense if you were not involved with the actions or relatives. I don't think they are even investigated at the TS and below level.

    I think there may be something else causing a problem.

    Sorry have not been able to post for a day.

    She was applying for an engineering position for a defense contract corporation.

    I'm only 17, but I assume the FOIA is the Freedom of Information Act?

    I'll ask her if they told her anything.
