Depends if it is just from other states? Or international? Then it depends on the Country for international ones.

For most states, they generally start by sending an NCIC switch to the originating jurisdiciton to confirm they will extradite. Then they just coordinate a time.

One thing that isn't mentioned here is that you usually have to do all this paper work, court appearances etc with an ENORMOUS hangover, due to the hospitality shown to you by members of the jurisdiction you have travelled to. Of course, if extradition is contested, you are "stuck there" for days (having the time of your life with brother officers !)

Hmmph.. never had to worry about the paperwork. Our admin usually lince that up. For the local arrests being extradited elsewhere, I just dump them and they can rot as the details of their extradition is worked out.

And you can miss the plane back to your jurisdiction with your prisoner because you were shanghaied in to the airport bar (with prisoner). It didn't happen to me thankfully but it happened to a visiting Detective who just happened to get tangled up with the worst crew in the CIB office I used to work in. Apparently he was typing reports for days and our blokes got in strife as well.

But back to the point. The extradition process here in Australia from jurisdiction to jurisdiction is fairly complicated and particularly so when the suspect fights it. I know why it is, the legalities and what have you, but I wonder at the sense of it.

An extradition hearing in the state courts, or a removal hearing in the federal courts, is really just an identity hearing. The courts don't get into the facts of the charge other than to determine that the person that is being sought for extradition is actually the person in custody.

We frequently have to send agents to other federal districts to testify that the person is actually the one they swore out the affidavit on or the one that was indicted due to their grand jury testimony.

This is pretty much a formality as Switch and his buddies rarely grab the wrong guy.

I just had a prince of a guy take his daughters car ( she was going to sell it for salvage) . He is hopelessly revoked/suspended , owes 27K in back child support and has 2 local bench warrants out for him. He lives in MAryland about 45 miles away and does come up here occasionally as to take his 21 yr old daughter's car. She told him he could have the car ( he is 52 and a drunken crackhead) as long as he trans fers the car out of her name, he refused.

I got a warrant for Misd 2nd Unauthroized Use of a Motor Vehicle and got extradition approved back to PA. They can't extradite him on the bench warrants or for the child support but my MIsd charge is enough to bring him back and THEN they can lock him up on everything else.
