Strange: Border Patrolman Sues ICE For Bizarre Search
TUCSON (CN) - A Border Patrol agent says three Immigration and Customs Enforcement officers forced him off the road in rural Arizona and held him at gunpoint while they illegally searched his truck. Jess Cabe says ICE agents forced him off the road and pointed guns at his head while he was in uniform.
Jess Cabe, a Border Patrol agent based in Nogales, sued three unnamed ICE agents in Federal Court, saying the 2007 incident has left him with posttraumatic stress disorder and other injuries.
Cabe says he was on his way to work at around 10:45 p.m. when two vehicles approached him from behind near Arivaca, a tiny town just north of the U.S.-Mexico border southwest of Tucson. He was driving his own truck and was dressed in his Border Patrol uniform, Cabe says.
The vehicles pinched him off the road, and three gunmen jumped out and pointed their weapons at his head, Cabe says.
Cabe claims he identified the agents by the small ICE patches on their clothing, but they were otherwise out of uniform and driving unmarked vehicles.
"As the man approached from the pickup, he yelled out 'La Migra' (a border patrol or law enforcement officer) to the other two individuals, referring to Cabe," according to the complaint. "That individual continued to approach the vehicle, and ordered Cabe to open the door and trunk of his vehicle. Cabe, fearing for his life, complied."
Cabe say the men searched his truck without probable cause or a warrant, then let him go.
Cabe says he reported to work and told his supervisor what had happened. His supervisor said that "I.C.E. agents were working in the general area on a covert operation," according to the complaint.
Cabe seeks a jury trial and unspecified damages. He is represented by David Quantz.
It is very strange, indeed. If ICE was out in that area, they must have been working either an alien smuggling case or a drug smuggling case. Either way, they must have had info about a load that would be coming down that highway.
Also, it is strange that a PA was living in that area. That is enemy territory. It's making me wonder if there was a good reason for ICE to stop the BPA's vehicle. Is the lawsuit a way to take the spotlight off of what was really going on?

I'm working in Nogales right now so I've heard a bunch about this. The guy lives in a place where the standard LEO would not live but he's from the area and has a range set up out there & does a lot of shooting. He's a firearms instructor and has taught at the USBP academy as well as being the lead firearms instructor for his station.
This is a pretty big topic on the honorfirst site and if what I'm hearing from several different people yes it was ICE and yes ICE is Fukked
Sounds to me like somebody might have given ICE a "hot tip" on a "corrupt cop" to divert their attention from somethings else.
Or... does this guy have a whacko ex?
Or, lo and behold (no, NEVER happen) ICE straight up screwed up.
Is it confirmed they were actual agents? We had a wrecking crew working our area on load rip-offs that were impersonating.

It could be just a simple mistake. Maybe an informant told ICE that a certain make/model/color vehicle would be brining a load of dope up Amado Road at that time. It turned out, the PA had the same car and drove up the highway at the same time the load vehicle was supposed to. Who knows? What I do know is that ICE doesn't play Border Patrol and sit on the highway looking for load vehicles. If they were there looking to stop a vehicle, there was some sort of information that led to the stop.
