The border guard decided Sekhon was suspiciously tense and sent him to be questioned in the customs office, where he was locked inside while another inspector searched the truck.

Seems this is where the BP screwed up on. But for the rest of the story I thank them for keeping 50 kilos out of the U.S.

It's all a bunch of crap. The laws for Canada as well as the U.S. specifically allow warrant less border searches. When you arrive at the border you are not "in" that country until you are deemed admissible and released by Immigration/Customs (now CBP for us and whatever the hell they call it on the Canadian side). While you are being Inspected/examined for admissibility, which includes regulations for us searching all luggage, persons, vehicles, vessels and plains without warrants, you are not being officially "detained" but neither are you free to do as you will. No one screwed up here except whatever idiot let that judge get to the position their in without actually KNOWING the laws. It's bad enough that, due to political BS between the Governments and big companies, we can't do the job we are supposed to be doing but if they got rid of the border search authority and made us get warrants for our searches then you'd have to just eliminate CBP. It is absolutely impossible to have us get warrants, physical, telephonic or otherwise, to search vehicles. There are MILLIONS of vehicles searched every day at the border points of entries. The thought that judges are going to have time to issue out that many warrants for routine border searches is just absurd. People need to pull their heads out of their butts and let us do our job. It's a hard enough job as it is stopping every car and having about seconds to ask a couple questions and decide if they are admissible and whether or not they may be smuggling contraband let alone having to worry about yet MORE political BS piled on top of our already collapsing mountain of it that we had to deal with every day. People in authority like the Judges should friggin be fired or hanged for this kind of blatant incompetence. This kind of stuff just helps chip away more and more at our already almost laughable national border security .... On BOTH sides of the borders!!

When I first saw the title to this thread I thought the ruling came out of the Ninth Circuit. It's nice to see we don't have a monopoly on idiot judges.

Shoot! That was my first thought, too, until I started to read it.

(Not that I don't think for a second that there isn't at least one federal judge in the 9th Circus who would rule that way if he or she thought they could get away with it). :D
