    Question about fingerprint based criminal offender record background check

    I was arrested for dui last year (no alcohol involved, it was prescription drugs) took a plea deal for reckless driving, paid a 700 fine and got 3 years non-supervised probation. No drivers license suspension.

    When I was arrested, I was at the ER because I lost consciousness and drove into a grassy median. I was never taken to the jail and fingerprinted, it was all done through paperwork.

    My question is this: will this conviction show up on fingerprint based background check like at the DOJ or FBI?

    Will it show up on any background check?

    Thanks for any info you can provide.

    Convictions are reported to Virginia's criminal history database (VCIN) by way of the court clerks. So if the case went to court (which you confirm it did) it would show that you were charged with DUI and what the charge was reduced to. This is probably the same process in every state, so to answer your question - yes it would show up.

    If your fingerprints weren't taken it would not show when they run your prints.

    But, it probably would show up when they run a computer check on your name or drivers' license number, since the arrests are still reported to the state.

    If you are asking if you still need to disclose it on a police application, the answer is yes.

    GoldFish777, first of all, Welcome to RP from the Florida Panhandle! Glad you found our little home on the internet! Usually, we ask our newest members to go to the New Member Introductions forum and post a thread telling us a little about yourself before you start asking a bunch of questions, which is considered bad form here. After you do that, please stick around and dig in and really explore the space as we've got tons of great info on here!

    As to answering your questions, I can't say for sure as I haven't ever experienced it before, but it sounds like the answers you've been given so far are pretty good.

    We don't report arrests to the FBI unless there are fingerprints. They won't accept them otherwise. The FBI is fussy about being sure of the identity of the arrestee and fingerprints are the only ID they will buy.

    We don't report traffic tickets to the state except of course, DMV unless you were taken to jail and printed. Same reason, they want fingerprints to verify the identity of the person arrested.

    The arrest will only appear on our records and DMV's.

    Wow, interesting. So, without fingerprints, crimes can't be reported to the DOJ or FBI. Am I reading that right?

    Does anyone have any idea why I wasn't fingerprinted? Was it a slip up or common when somone ends up in the ER unconscious for a few hours? Why didn't the police have me come down later and officially book me? You would think they'd want my mug shot and fingerprints on file.

    I'm not applying to be an officer or anything, I'm a nurse who has a nursing board who will pitch a fit if they find out I got any kind of misdemeanor especially one involving prescription drugs. It's complicated but I'm thinking it'd be a lot more uncomplicated if they just never found out about it. They only check the DOJ and FBI files.

    Thanks for your advice.

    Crimes reported, individual arrests not as of 1998 when I retired.

    We don't book for DUI's unless it's a felony.
