    273.5 Arrest

    7 Years ago I was arrested for 273.5 and I was released the same day. At the time I was divorced and my ex-wife and I had a big argument because some guy called her house while I was babysitting the kids. I was upset, still in love and attempted to leave her house. She had to be at work, and at that time I didn't care because I felt disrespected.

    To make a long story short she went crazy, she hit and pushed me and I called the cops on her. When the P.D arrived, we were both taken into custody but she had no signs of visual marks that I hit her. She did try and cut me with a dull knife, and in the struggle to take it away she cut herself. No charges were ever filed but this is still on my arrest record which means that I have to disclose this to background investigators.

    I recently applied with an agency, and they disqualified me yesterday. The Sgt. said that although no charges were ever filed, this does not look good. I also provided them with a letter from the public defender's office stating that she had no bruises or marks, and I was not the argessor.

    Here it is 7 years later and we are now remarried and that was the first and last time for that one incident. We now have 3 kids we're a loving Christian family but that doesn't make a difference. I just put myself through a police academy and I graduated not to long ago. I'm now post certified and I'm looking for a job as a full time peace officer. I'm cleared by Department of Justice to legally possess a firearm so hopefully other departments will be more understanding about this incident. I was told that as long as it wasn't a conviction, I would be ok and like I said I was released the same night with no charges ever filed. Give me some advice? I have all supporting documentation stating that I was not the agressor.....

    File a notice of appeal with the civil service commission. They have the ultimate authority in California over who gets hired, fired, disqualified, etc. Each county has their own commission.

    You might want to hire a lawyer to explain your rights and to represent you in any appeal.

    But doesn't every department have the right to hire or not hire as they see fit? There may be an applicant who is as equally qualified as you but DOESN'T have the arrest record. Who would you pick? If someone had a whole bunch of "arrested but not convicted" on their record it would still be a red flag and I think a department would be right in passing on that particular applicant.

    Me being arrested 7 years ago for something that never went to court does not mean that I'm not as qualified as someone without an arrest record. I'm not upset that I was disqualified, I was trying to get a feel for what other departments may do when I get the the background investigation. I was cleared by Department of Corrections but I'm interested in working the streets.

    Look at the guys in my academy class that just graduated, some good some bad. You take a person like myself with an arrest record, and you take another cadet without an arrest record and compare. We have grown men hired with agencies throwing wet paper towels on the ceiling in the restroom, crying and complaining about every little thing, playing kid like games just plain old immature boys. Who would you rather hire as a partner? Everyone has made mistakes, and I'm very serious about the law enforcement field. I worked full time and after work I put myself through an academy.

    I have a lot of life experience, growing up in South Central Los Angeles. I've seen it all so I know that being an officer is no easy job. My life experiences have better prepared me for my career in law enforcement...

    Inflicting corporal injury on a spouse or significant other

    So I guess that means if you are inflicting general injury on a spouse, that is OK

    :D

    SO you were "taken into custody" but no charges were ever filed ? Sounds to me like you were never arrested. Or if they say you were, than your criminal history would show that the charges were nol prossed.

    You ought to try to find out what EXACTLY is on your criminal history.

    Perhaps you should say , " I was taken into custody on suspicion of domestic violence but NO charges were ever filed and I was released a few hours later" I never went to court, saw a judge etc etc. I paid no fines, court costs or went to jail. Were you even fingerprinted or photographed ?

    If your criminal history is completely clean, you can say that NO charges were EVER filed against you. This should be easy to determine although a lawyer may help get it done properly.

    You would have some explaining to do, but I am surprised they Dq'd you for that.

    If everything else was good, why did they dwell on that??

    Or is there other dirt in your past??

    You were arrested...plain and simple. Don't beat around the bush with the issue and be straight with it.

    If you push it with that dept., you will never get hired there. Start looking elsewhere.
