    fleeing and eluding

    A little background. I was in the Army for a few years with one deployment and am currently in the National Guard and working on a degree. About a year ago I was coming home from a drill weekend doing 97 in a 55 zone. I passed a county sheriff and turned down a back road. Once I saw him behind me I pulled over. I was arrested and got the charge knocked down to an attempted fleeing and eluding misdemeanor. I have nothing on record but a couple accidents when I was 17. One involved an injured person but I was not ticketed. From what I have been reading only time away from the charge will help but will this DQ me.
    Also, while in the military as an E-3 my platoon sergeant gave me a case of mres after a field problem. Our CO found them and gave me a summerized article 15 for "theft of govt property". Will that follow me as well? Thank you in advance for any input.

    Well, it won't look good especially only being a year ago. Were you trying to elude?

    Was the military article and actual charge? If so then it probably will be disclosed in a background check.

    You may have to put some time between your "problems" and when you apply.

    The article 15 will follow you and you will have to explain the details surrounding it. Not sure how your Platoon Sergeant "giving" you MRE's ended up as a theft, or why your Sergeant didn't cover your *** when questions about it started up, but it happened and you're going to have to answer to it.

    I'm a bit confused hot a speeding deal got turned into an Eluding if you pulled over as soon as you saw him. In my state, it takes a lot more than driving fast to get hit with an Eluding charge. Anyway, that's going to be a toughie for ya. Expect to get questioned about that a lot.

    Not sure I understand what the charge would have been for the speeding and how Fleeing is a better charge ?

    Fleeing and eluding is a felony. Since I had nothing else on my record they knocked it down to a misdemeanor. My lawyer told me that the cop said he turned his lights on when I passed him and if I tried to dispute it the would try me and most likely charge me with the felony. Anyways I have also been told that some larger departments will likely still hire me with this on my record and that after 5 yrs it is possible to expunge the fleeing and eluding off my record, assuming I don't do anything stupid.

    Just a word of advice, expunged or not, the background investigators will more likely than not find it. So it's best to report it and explain the circumstance.

    NO LEO agency I know will hire you with your past.

    On a clear night, I can see the other deputies emergency lights at least 10 miles away.
    But it isnt flat here LOL

    Did you have any business turning down the dirt road? It certainly sounds like you were evading the deputy because you did want to get the speeding ticket and only gave up when he was able to get on your tail.

    I don't know if the Non-Judicial punishment in the Army and the eluding incident will necessarily disqualify you from every law enforcement agency in the states, but you will certainly need to put some good behavior time between the incidents and applying to indicate a desirable candidate.

    Might try getting your foot in the door by working in a state or county correctional field for a while. Show up for work on time, don’t abuse your sick leave and don’t get in any trouble for a few years, then start applying at departments.

    Please understand ,that expungement does not mean 100% gone. You will still be asked ..." were you ever arrested ?" and " did you plead or were you found guilty of any crime ?" Simply because you had a charge expunged does NOT mean you can now say ... " I was never arrested etc".

    In fact , it sounds like you were arrested for a felony and than pled it down to a misd. So , regardless of the outcome or any expungement , you were arrested for a felony.

    That just doesn't go well with a LOT of PD's.
