I recently failed the question whether I engaged in unlawful sex acts. I am now rescheduled for a specific poly for next week. Is it advisable that I come clean and state that I have solicited prostitution on numerous occasions? (I have a clean arrest/criminal record btw). Will this admission be an automatic disqualifier? Can this admission result in prosecution? I'm in CA.

:eek: I had to pick my jaw off the ground before I could answer this. Should you "fail to come clean" and admit to having sought out a prostitute, you are quite likely to fail the second polygraph as well. Therefore, there is no real point to taking the second poly unless you do so.

The fact that you have a clean record is irrelevant. It obviously simply means you were not caught in the act.

Not knowing the specific agency's policy, I can only tell you what would happen in Mesa where I had contacts in hiring. Yes, you would be disqualified from the hiring process. You would also be banned from testing with Mesa again. Please note that this would occur not only because of the act, but because you were dishonest about it when asked. It is also possible that Mesa would send a letter to AZPOST with the relevant information and you would not be able to obtain state certification from any agency in AZ (One applicant admitted to having had sex with an animal).

I do not believe your admission would be prosecutable as you were not caught in the act. This was discovered during a hiring process, not a criminal investigation.

Your actions are not those of someone who should be in law enforcement. Please consider another career field.

Not to poke fun at you BUT who has the name "dirtyharry" and gets away with prostitution allegations? :rolleyes: Why were you nervous if you didn't commit illegal sex acts? It's just a question; Did you notice that they asked you the same thing 2 or 3 times? (Gulp) Not good!

I was told by my background investigator that the dept. is concerned that sexual predators are not hired on (ie, rapists, child molestors). According to this investigor, many applicants admitting sex with prostitutes have been hired by this department. I suppose that such situations are looked at on a case by case basis.

If you solicited a prostitute, you should have said so from the get-go. They surely asked you those types of questions before you were hooked up for the poly. Basically, you lied on your PHQ, therefore you have no integrity, therefore you should not be in LE.

No dirty harry do not come clean I am sure you will pass next time because this is how to beat a poly. You Lie, Lie, and lie some more and you will pass no problem:rolleyes: Also I don't think in some instances a clean record means much especially after you fail a lie detector test for LYING!!!

If you were told by the BI that soliciting a prostitute was not a automatic disqualification why did you ask this question? Also what is the need to get a prostitute? I do not understand it.
