Felony Dismissal

Ten years ago in my dumber days

, I plea bargained a felony charge, however, it was later dismissed by another judge under PC 1385. I was the co-defendent. In the county that this incident occurred, there is no record of this incident except for a seat belt ticket in 1994. Is this something I should disclose? What are my chances to passing the background check for CHP? What are my chances? How does a dismissal work in a background check? Is it the same as expunged? Thanks!!

It there was no conviction of the felony than there is no conviction, however you should disclose everything, every detail to the background investigator. He's going to look into everything and he'll find out one way or another. It would look very bad if he found this out when you should have told him. The very fact you were charged will look bad, however if there is no felony conviction then it's not an auto DQ. A LEO will be along shortly to give a more detailed explaination.

You NEED to disclose ANY arrest regardless of the final outcome. To do otherwise is concealing information and will get you PERMANENTLY disqualified. Explain the entire situation and hope for the best. But if they find out when you didn't disclose it, you will be GONE.

PC 1385 merely seals the records in CA. You're screwed out of luck. A plea bargain is just as bad as a conviction generally.

I am willing to bet there IS a record of this somewhere. Felonies may be gone but they are not forgotten.

You need to tell them everything you have done...Caught or not. You should be telling them about any crimes, expunged or not, all the way down to something as petty as stealing a dollar from mom for a pack of bubble gum.

Gee, I feel left out. I want to be a cop & I've never used ANY type of drugs, stole, killed someone or anything else illegal. I have a few speeding tickets from the past few years, at least I have that.
