    Background Question.

    In 2000 I was disqualified by the L.A.P.D. I was never assigned to a background investigator, but after they reviewed my personal history packet, I was told that I couldn't be hired due to my financial history. I tried to appeal the decision but my case went to the Board of Commissioner's and I was permanently disqualified.

    Department of Corrections also did the same thing but I've since applied a second time and I'll be in backgrounds when the freeze is off. I applied the another agaency one year ago and after I turned in my personal history packet, I withdrew from the process. I put myself through an academy and I didn't have the time to gather the needed documents. They sent me a letter and advised me to reapply after I graduated from the academy.

    That's a total of three agencies that I've ever applied with. I now have my academy certificate and I will be applying for jobs as a police officer once again. When I make it to backgrounds will departments personally go to the departments that I applied with?

    The L.A.P.D had a problem with one particular arrest also, and I petitioned the court for a finding of factual innocence (851.8). My request was granted and all agencies that I'm now applying with states that I don't have to list an arrest if I received a finding of factual innocence (851.8). This was originally a misdemeanor for carrying a concealed weapon, and I had it expunged. This has now been completely removed from my arrest record through Department of Justice after my request was granted to have the record purged and destroyed.

    How will this affect me since this was an arrest on previous personal history packets that I've turned in. The judge told me that this arrest is deemed to not have occurred. I have a new packet that I'm filling out and it's in bold letters, if you were arrested and received an 851.8 you need not list the arrest. I don't have to list it but if my investigator goes to the other departments he'll see the arrest that no longer exist. Can this be used against me in the background process?

    I am currently being investigated by the CDC; all of my references have recently received a background questionnaire. The next academy will be January 2005. I took the written in September and the PAT in October.

    If the packet specifically says that you do not have to list it, then you do not have to list it. But any packet that does not specifically say that, you definitely have to list it (failure to could be automatic DQ). And either way, they may find it. It may be used against you and it may not, it depends on the totality of the circumstances.
