    TEXAS, Speed Limit LAW

With the change in the speed limits, when driving in rural areas if the old signs have not been removed to reflect the new speed limit.

For example, 70 daytime speed, nighttime speed 65. I am driving 70 mph at night will I be ticketed if the old signs have not been removed ?

    Thanks in advance,
    Steph

I wouldn't worry about it too much. I don't write many tickets for 5 over although i have (pop offense). I have already begun to ignore the night time speed. When I'm up on the interstate it doesn't take long for me to snag someone doing 20+ over the speed limit. If I'm looking for dope I normally stop for other reasons cause drug runners rarely speed. Its really going to depend on the officer that stops you but for now the safe bet is to keep your eyes open for the speed limit signs.

You should not be ticketed. But there is always one of those type of people in every profession!

I think like y'all, I have never been ticketed out on the road for 5 over but I would not try it on the hwy in city limits until there was new signage.

Five over is the speed limit in PA (people here don't have much respect for speed limits here).

Yeah I would be careful when passing through small towns/townships. Most of the guy/girls I work with aren't going to stroke off tickets for 5 over. Our call load dictates how much traffic enforcement we do. Our Troopers say "give a nickle take six". In Texas we can technically issue a citation for 1mph over. Do I know anyone that has done that, no.

You could be ticketed for a 'lesser' offense here- failure to obey a traffic device. Unlike the 'speeding' law, it's no points and a fairly small fine. Would you be ticketed? Probably not. But you never know...

What exactly is a traffic device, would that be a camera?

Here we use traffic device as a broad term (traffic control device actually). It can be a red light, stop sign, speed limit sign, no turn on red sign etc. Essentially any sign that controls traffic in any way.

Yes, sorry, that's what I meant. If you are going at the speed limit, and the signs aren't changed, you are not speeding. However, you may be failing to obey the signs (traffic devices) regardless, depending on how the code is written.

I doubt it would result in a conviction.
