    Expunged still a DQ? (in Ohio)

    I had a juvie possession charge, it was expunged, is it still a DQ for an LE career?

    It's keeping me out of the military and I assume a background check for LE would be just as stringent...

    Other than this my record is spotless, never done anything bad to anyone, never been arrested or charged at all. Honestly LE is my second choice, yeah, but it's still a job I could devote myself to and find fulfilling.

    Taking advantage of online anonymity, if it wouldn't show up in a background check, but I was asked, would I be required to volunteer the info? If I lied would it come back to bite me later?

    Depends on the state. In Oregon, expunged means gone, destroyed and the court order specifically says that you can say you were never arrested. However, it's not that way everywhere. Some states only seal it and it's available to certain people/agencies.

    California's Point of View

    Any person convicted of a felony (or of a crime in another jurisdiction that would be a felony in California) is prohibited from employment as a California peace officer [Government Code Section 1029(a)]. This prohibition holds even if the conviction was sealed, expunged, or set aside. It may also apply to any convictions that were subsequently reduced to a misdemeanor occurring on or after January 1, 2004.

    Proceedings under juvenile court are generally not considered to be a criminal conviction under Government Code Section 1029 unless the individual was certified, tried, and convicted as an adult. Therefore, juvenile convictions are not included as a legal bar to appointment as a peace officer. However, the conduct surrounding the offense should certainly be considered as part of the overall background.

    Sorry I should have said I'm in Ohio, I wish I was in cali tho lol

    The ORC says something sealed is restricted and stored separately, expunged is like you said about oregon. They physically destroy the records.

    I guess one's juvie record is automatically expunged at 23 here, no one told me this, and I was ecstatic to learn this. Still sucks tho that the fbi will find it so no Army job for me :(

    Any local LEO's have an answer?

    Lets say you turn in you background statement and get hired as a police officer. So now you have a job and somewhere along the line the truth comes out. Now your agency fires you because you lied. I think your best bet is to be honest.

    @TEXASCOP i suppose i should have worded that better, by 'lying' I meant 'omitting', if it's expunged and won't be found, and i'm legally OK not to disclose it...then i prolly wouldn't.
    all the classes i'm taking now are geared toward pre-med but i could easily switch majors, at OSU pre-med isn't even really a major, it's like being undeclared with a purpose. becoming a cop would be cheaper, faster, and just as enjoyable...tho i'm on a track to make a lot more money now. idk. i'm in a weird spot and trying to settle on a career but my interests are too varied lol

    The problem you are going to have is that sometime during the background, interview, or polygraph you are going to be asked about any crimes you have committed wether undected, expunged or not. It will look much better be up front and let them determine if it is a DQ or not.
