    I Need some help, I am teaching in a private school for adults and we have had a hard time with one of the students she became violent in class over the use of a cell phone and one thing led to another she was not expelled but should have been. She ended up taking a leave of absence with a week of suspension and is due to come back soon. In the mean time she posted some threatening things on Face Book and I want to know what is my recourse to this person it has been brought to administrations attention, but nothing has been done. She is not balanced and I believe she has a criminal record, I want them to drop her from the program, the other students are scared of her and she has contacted several of them, thats how I got the FB stuff. I have to admitt I also am scared. What is my legal recourse?

    The bolded parts are subjective and/or very vague. You should contact your local law enforcement agency and tell them IN DETAIL what is going on. IF it turns out that what the student has done was not yet criminal, and your school administration refuses to do anything about it, then you might want to look at finding somewhere else to work...

    I have a dillema, I teach in a private school and we recently had a problem with a student who was extremly aggressive and violent, she ended up being suspended and took a one month leave of absence. She is due to come back to school soon and is transferring to nights I also teach nights she would be in my class again. Since her suspension and leave it has come to light that she has been posting on Face Book some threatening things and other stuff about myself and the other teacher in the room during this episode of hers which got her suspended, I have brought it to administration and it seems the answer is to tell her if there is any type of episode again she will be expelled. This is not acceptable to me as I am fearful that violence will ensue in my opinion she has nothing more to lose so what the hell, she will do what she has threatened. I have tried to look her up and she if she has a criminal record but have not been able to get far with that. I want to know more of what I am dealing with, some of the students are extremely upset over it, she has contacted them through FB. How do I protect myself, and where do I start.

    It sounds like the administration should have a sit down with the student and her parents. It is their job to make sure you and the other students are safe.

    A lot will depend on what she threated to do an what state you live on. Can you be more specific as to what she has threated to do to you and the other teachers ans what state you are in?

    I would also be printing anything you find on the internet about statements she has made. Under OSHA rules, your employer is obligated to keep you in a safe work environment. When people think OSHA, they normally think of chemicals and such, but this also applies to violent behavior by those in the workplace. The main question is if the actions are forseeable. Now calling you bad names on her fb page isn't going to lead to much, but as L-1 has asked, are there specific outlined threats? If so, it needs to be pursued further. As far as the girl's criminal record, if she is juvenile you're not going to be able to access that information.

    I work in a cosmotology trade school, this person is a 28 year old with 2 children, forget about parents. Sorry to say this but the state sends them or funds them, when they don't know what to do with them. I have students that range in age of 17 to 40 plus.

    New York State and she has threatened to slap our lips off and then they are going to find pieces of us on 84, also knub us and cap us and cut us with her scissors. Isn't this enough? I work in a trade school for cosmotology and we have all walks of life and ages. Sometimes we are getting students who need rehabilitation because of circumstances, I beleive she is one of them; based on her FB stuff which was hard to read due to the slang and her getto referances. In my opionion not reality based, no let me rephrase totally street, when I was reading some of this crap, one pharse stated she was going to committ a double murder suicide.

    I replied to L-1 and others this morning the OSHA thing is interesting, I would say that you cannot forsee if something is going to happen its totally unpredictable, this happened in theory class during lecture over a cell phone it was 40 minutes of insanity, we have rules and they apply to everyone, but some how she thinks and I quote "imma grown *** woman and I shouldn't have to", we had to evacuate the class as she would not collect her things and leave and the racial slurs and violent rants continued the admin. was asked to call police to have her removed but they wanted to ease her out but it was a bad call. I immediatly asked to have her removed by police escort, but it did not happen as far as FB I printed it out and had a talk with the director and she asked to keep copies of the stuff. The students are frightened of her, they have voiced it one of the coordinators is going to speak to the owner on Monday as we beleive our director has dropped the ball with this one. I was told about the FB by the students, and one of my graduates who saw it acutually came to the school and was extremely concerned, so the students plugged me on to their FB and I found it and printed it out. This is extreme for where I work and I beleive their is nothing for this one to lose, so next time it will be worse. Blood will spill. We are the only ones who take students in our school and hand them a bag of weapons, great trade the hair industry.

    Beauty school = BUSINESS, not a "school" or "private school for adults"

    If your business owners are not willing to do anything about the problem and are allowing the problem to be there, you might have to consider quitting and going somewhere else - ditto for the other students and clientele.

    I can't speak for New York, but my state has a law that prohibits making electronic threats of bodily harm that cause the recipient to be in sustained fear for their own safety. This includes threats where the person making them had no intention of carrying them out. I would contact your local police, see if they have a similar law and seek prosecution.

    You can also seek a restraining order which would prohibit the person from coming having contact with you or coming within so many feet of you. This would prohibit her from being in your class and depending on the scope of the order, possibly keep her from being on the school grounds.

    Should you choose this route, I would minimize any further discussions on this matter further with your employer as this is now an issue between you, the police and the courts.

    As a side issue, most states have laws that make it illegal for someone to dissuade a witness from reporting a crime or testifying in a criminal case. For this reason, your employer should not attempt to dissuade you from reporting this matter to the police or seeing her prosecuted.

    You can easily fill out a complaint from the link to get the ball rolling. That may help speed things up about the problem child (woman) in your class. If you don't want to go this far yet, it may be beneficial to let your employer know that it's the route you are considering to take if something doesn't get done about this person in your class.
