Sexual harassment penalties?

I'm a Junior in high school in Jacksonville, North Carolina and I refuse to let sexual harassment become a problem with my girlfriend. What is the minimum and maximum penalties for SH in NC in the school place? I've heard just the accusation can land the accused in jail for at least 2 nights. I understand the procedure for filing complaints and taking action to prevent SH. I've also heard it's classified as a class 2 misdemeanor. I'm just curious of the punishments. I plan on sharing the information of whoever replies with any harassers. Thank you in advance

Describe this "harassment", because "sexual harassment" isn't actually a crime... it's a civil liability.

It is possible that what's happening would fall under a criminal act of some sort though.

I just want to know IF something happens... Let's just say someone is talking and acting in a way that makes her feel uncomfortable. such as carrying, touching, or tickling her

There MAY be some codes/statutes that apply BUT, since you're not giving any info, we can't say for sure. Also, you need to make SURE that the "attention" is UNwanted and you're getting the ENTIRE truth...

There's more to the story. First, she needs to report the inappropriate behavior to a teacher and/or her parents. Are you talking about another student or a teacher doing this? Has she told him to stop? There's quite a bit of difference. Since you're talking about a criminal context, it's either going to be harassment (not sexual related) or sexual battery. Sexual battery by an authority figure is worse.

Regardless of who's doing it, she needs to report the behavior. It also needs to be apparent that she doesn't approve of whatever is going on. If she just shrugs it off or giggles, that doesn't tell someone that whatever they're doing is not welcome.

On a side note, picking a girl up, tickling her, or touching her shoulder is not sexual battery or normally a sex-related crime. It may be against school policy and/or be construed along the lines of harassment. Sex related crimes deal with the obvious sexual areas.

Probably not, unless it is grossly obvious that the action was out of line. Things that come to mind as being obvious are touching areas (not sexual areas) that normally are not touched in public (inner thigh or areas near the breasts) or saying I want to do x, y, z to you.
