Domestic hate-crimes, FL

I live in Palm Beach, Florida with my mother, grandmother, 22 year old brother. I'm 18.

I am gay, and on a weekly basis my brother makes some type of demeaning and disgusting comment. this has been going for about two years, but happening more often now to the point i cant stand it.
he's physically assaulted three times within 2 years too, but I was only a minor then.
he is on probation right now for a robbery, and domestic violence between him and my mother, and is just nothing but scum to me.

he says either directly to me or behind my back, things like "F-cking fa ggot", "d-ick slapper", "god dam fa ggot", and one point had an adult friend with him who both said "what do you all day in your dungeon (my bedroom)? you just jack off all day."

there is a locked door between his and my room, and above the doorway into my room from his, "FAGS GO HERE" was recently written in sharpie.

this is the first time he's written something and i believe can be used as evidence of how disgusting and sick he is. i took 4 pictures. what can I do to get the court and police involved to end this?


Im aware of restraining orders, but don't know if that is possible because we are in the same house. I want him arrested. taken away. anything just to get him the hell away from me. but I wont let him drive me to the point of leaving home myself.

I know that Florida is one of four states that recognize "sexual orientation hate-crimes" specifically.
is there something that can be done immediately with the physical evidence of it? and what can I do for the long term?

If he is not going to leave then you should. You are 18 get out on your own, rent an apartment with a buddy and leave your miserable brother to fester in his own hatred. I don't think the cop and court stuff would be the right move in this case.

Here's the problem with the sign as evidence. If I understand your post correctly, the sign is in HIS room. Now I may agree or disagree with what the person's opinion is, but a person should be able to do whatever they want in their living space (even if that person is a piece of garbage still living at home at the age of 22, and that living space is their room). And I would hope (and Im not taking sides, I believe this in general), that no judge would convict someone using their predjudice against them using something done in their own living space as evidence.

ok. same answer that i got from another officer the day i posted this. i don't plan to be here much longer, but was hoping something would be possible until then.

she is not my biological mother, and she's not at all relevant to this.

The physical assaults are criminal, however depending on when those happened, nothing will probably be able to be done about it now. Everything else you describe so far is not criminal in Florida. You may have justification for a restraining order, but not for any type of criminal charges. Verbal comments are not illegal in Florida, no matter how hateful they maybe. Your best bet will be to move out, or try for a restraining order.
