    Charged with Phone harrassment

    Hello and Thank you for your service. Ohio Resident.

    Two years ago my x-boyfriend cheated on me and I left a threat to him on his answering
    machine, I know stupid I was very upset. I have had no contact with him since that call two years previous and accidentley butt dialed him last week. He called the police and swore that I said I was going to kill him. They called me and I said it was an accident butt dial then asked me to come down and write a statement which I did but before I even wrote the statement I was told I was under arrest and read my rights. My statement was accidental butt dial and That is it. I showed up for court and am now charged with a M1 phone harrassment.

    My question is: How long does a police order not to call someone last? My understanding is even a Judges restraining order has a time limit, review process and court hearing none of which I was given just a officer saying don't call him again. Yes I erased his number from my phone and I work for the State so a m1 charge could cost me my job not to mention six months in jail and a $1000 fine. I have never been in trouble before. Please some advise. All the attorneys want $5000 and I don't have it..

    If it happened two years ago, how did you have his number in your phone to even "butt dial" him?

    If it wasn't recorded, basically it's your word against his in court. I would recommed hiring an attorney or speaking with the prosecutor that is going to be handling your case. If you ex admits that it's been two years since any contact, I would think the prosecutor would be more likely to believe your story.

    I too am curious why you even had his number.

    And here it depends on the protective order. We do have orders that last for years and in extreme cases, ones that never expire.

    When I switched from my I3 phone to my new I4 phone all numbers, names pictures, texts etc are stored Via Itunes. I have numbers from old baby sitters, dead friends, and people I I haven't talked to for years. Its just the way the system is set up. Anytime you sinc your new phone to Itunes it saves your data and reloadsall when you sinc it. I have 400 phone numbers on my new I phone and don't know how to permanently erase them from Itunes back up.

    I'm sure there's a way to erase the numbers, but fair enough. That's not really the main issue. I would recommend hiring an attorney.
