    bench warrant question

    Hi, I had a question about bench warrants. For the last three years I have been in "contact" with the courts for two misdemeanor charges I plead guilty to back in 2008. Never once have I missed a court date, I completed my probation and now I'm paying off restitution. I still owe some restitution and had a deferment date on Sept. 7th. My cars engine blew two weeks before my court date. I contacted the judges clerk many times and never got a returned phone call. I ended up missing my court date and now there is a bench warrant issued for me. I live 160 miles away and have no way to get there to take care of this and I have contacted the courts since. What should I do? Will they travel that far to come get me?

    Get a ride to the court and straighten it out. Tell the Judge your story and give him the dates and times that you say you called the clerk and what messages you left. I will tell you that it is hard to believe that your engine blew 2 weeks before your court date and you could not reach a single person at the court to tell your story. I don't buy it, sorry.

    Take a tow receipt . repair receipt etc. to back up your claim.

    I am not questioning that you had a problem with your car, I am questioning the fact that you could not get a hold of a responsible person in that 2 week period. Mcsap has a great point about the car receipts. If you did call the court numbers on your cell phone bring the bill with the outgoing calls or call your carrier land line service for the information.
