    Ecstacy.

Hello everyone, recently I was high with some of my friends, police officers stopped us and immediately started asking us where the pills were. This was quite unusual as they had never asked for pills before. I was in fact under the influence of these pills. They came at us and asked me for a piece of ID, I took out my wallet and they grabbed it from me. Inside my wallet they found 8 pills. I understand this looks, terrible to say the least.

This kind of went badly. The police officers placed me under arrest and started reading me my rights. I faint when I am nervous and so... I fainted. I was down for a little under 8 seconds before getting back up. One of my friends (I was the only person they searched or even asked for ID from) told them it was an illegal search and immediately they let me go telling me I would receive a court date by mail. I had some emergency respondents check me, I was completely fine just very scared.

I am 18 and have no record with the police. I live in Montreal in Canada. Basically I would like to know how bad things look for me. Am I guaranteed to get a permanent record? Will I really never be allowed back into the US?

I am a good kid, I study hard, I have a job, I pay all my bills, it was my first time ever doing anything other than smoking Marijuana. I have been completely clean since. Then again, I am sure that everyone says they are "good kids"...

Sounds like when you get your charges in the mail , you may want to then call a lawyer. We will side with the officer on the legality of the search and not your " friend whose legal education comes from watching TV ".

I don't know much about you but I do know that you choose to use 2 kinds of illegal drugs , one kind that is extremely dangerous. That doesn't sound like a good kid , sounds like someone who LIKES to get high and use ILLEGAL drugs. Drugs that can cause you to have a felony record.

Is this how you want to live ?

It was my friends 18th birthday, and I will admit they aren't very good friends. I have not seen them since because they told me it was their fault and felt sorry. Nothing in my possession was mine.

And I do believe that the police officers knew it was an illegal search but were caught up in the moment. They were both very young, VERY. And both of them also said I was the first person they catch with anything. They recognized I wasn't trying to harm anyone and they were actually really nice to talk to. It was my first time every doing pills. First last and apparently my downfall.

Based on what you know, do you think I could ask for an open record and like 100 hours of community service? Or should I just take the bullet and have a record. Also, does having a police record prevent me from entering the US?

If you have them....they are YOURS.

I was very young once as well. I still arrested a lot of people. Believe what you want but I am sure that your legal expertise is nowhere near theirs. Wait and see what you get in the mail. It doesn't matter what you were trying to do. Possession is the CRIME. The only thing that could have made it worsr is a PWI charge ( selling) and having 8 pills borders on not for personal use.

Based on what you know, do you think I could ask for an open record and like 100 hours of community service? Or should I just take the bullet and have a record. Also, does having a police record prevent me from entering the US?
I will not tell you what to do or ask for beyond this , when you get your charges call a lawyer. THEY are the legal professionals who can help you get through this with as little damage as possible. And quit taking legal advice from people who aren't TRAINED in the law.

If they weren't yours, how did they get in your wallet?

As mcsap keeps telling you, your friends aren't the best source of legal advice. You made some pretty dumb decisions and you will probably have to suffer the consequences. BTW, the search here would be fine if you were visibly high.

Spoken like a true criminal. If you want us to feel some sort of sympathy here, the best thing you can do is attempt to take RESPONSIBILITY for your actions. The pills were yours. You were using them to get high, and it appears you had plans to use more. In my state, eight is probably enough to hit you with possession for resale, a felony here.

And I do believe that the police officers knew it was an illegal search but were caught up in the moment.
Obviously we don't know all of the details, but from the jist of the story it doesn't appear to be an illegal search. Age of the officers has nothing to do with it. Search & seizure are well taught in law enforcement academies. If they were already asking you and your friends about "the pills," then it appears they had prior knowledge that you had them on you, which gives them plenty of cause to conduct a search.

You come to this site apologizing, yet you accuse the officers of an illegal search and can't even claim responsibility for drugs that were in your wallet. Don't waste our time here.

    Go to a lawyer website.

Actually, Officer, it was given to me by "Some Dude". I spent a career looking for the man named "Some Dude".

I doubt they let you go because your friends intimidated them into thinking they performed an illegal search, rather they let you go because they didn't like the idea of possibly having to babysit you at the hospital all night while you got medically cleared for being under the influence. You're going to have a very hard time convincing anyone--especially a judge--that you didn't know anything about drugs that were in your own wallet.

I always remember an episode of COPS where they searched this guy and found crack in his pants pockets.

his response was, "These aren't my pants!!!"

    Funniest episode ever.

I also love when drug affected teens think they know more about the law than Police.

A few weeks back I stopped a guy for a traffic matter. Given the incident I initially intended to just have a talk to him, give him some advice....and then he opened his mouth....which showed me that advice and a caution would have fallen on deaf ears and not been a suitable way to correct this young man's behaviour.

He immediately started telling me that what he was doing was not illegal (riding a bicycle with no helmet - Trust me, it is here) Now that on it's own is not something I jump up and down about, but he was on the footpath, going down a hill, into a busy school zone with a heap of young kids about, and I clocked him at about 65 kms an hour....accident waiting to happen.

His idea on it was that it was not illegal to ride on a footpath with no helmet. I assured him it was. He told me his friend, a cop, told him it wasn't. I asked his friend's name, but he chose not to tell me. I told him his friend was full of sh1t, he was full of sh1t, or one of them was mistaken, and I was willing to bet my understanding of the law against his and his friends.

    I wrote him a ticket.

It was what happened next that took me by surprise. He sat on his bike off to the side, while I chewed the fat with an officer that had pulled up to check on me. I deliberately did not drive off as I wanted to make sure the cyclist would walk his bike home. He then approached me, and apologised stating, "You're right it is against the law. I just checked the legislation on the net" showing me his iPhone and the website displaying the traffic regs!!!

I just replied, "Told you so."

I couldn't believe he checked the legislation!!! Maybe he should have done that sooner, especially as a check of his records showed that he had numerous similar tickets. SLOW LEARNER.

Oh, and to Heppy, have you ever seen a drug lab, or the kind of people who "cook" these drugs? trust me you were harming someone....you. And some time it is our job to protect people from their own stupidity, especially when it comes to pill popping druggies. Good luck with life.
