    Marijuana Smoking Next Door?

    If I'm outdoors in my backyard and I smell the aroma of marijuana smoke coming from the next-door neighbor's yard, should I call the police? I'm not making this up: I have a very acute sense of smell. Because of the wooden privacy fence separating my yard from theirs, I'm not about to peer over the top of the fence to see if anyone over there is really smoking pot. But, I'm pretty sure I can smell it. Also, I know one of the residents next door was arrested several months ago by local Sheriff's Dept. and city police because I saw him lead out of his house, handcuffed and taken away. This guy was away for several months (probably in prison, for what I don't know) but he's been back a month or so now. In my mind, the presence of an ex-con next door and the smell of pot wafting into my yard from the direction of their yard adds up. Also, do you have any tips on how I can try to rest easier in my own home knowing there is an ex-con residing next door? I'm in TX and have my CHL and our state honors the Castle Doctrine. Even with all that, I still don't feel 100% safe in my home with that guy next door. We do have a Lab dog who is very protective also. Any suggestions? Thanks.

    You can call your local PD the next time you smell it, but there are no guarantees the police will be able to arrest anyone. If I were the cop responding to this type of call, I would rather meet with you first, or speak to you on the phone. That way I can kinda make it a point to hang around the area and maybe catch them in the act. Or maybe a traffic stop could net an arrest. If you know the guys name you can call your county probation office and find out if he is on probation. If he is then tell them everything you know, and his probation should get revoked IE he will do the rest of his time in jail.

    On a serious note you have to weigh your options.

    1. You call the cops, they come out and knock on the door and the dude doesn't open it...or he does and absolutely jack **** can be done about it. In Houston our DAs will tell you that if a drug dog hits on the outside of a house that you can draw up a warrant. But in all likelyhood that is not going to happen and no officer and DA is going to go through all that trouble to catch a user.

    2. You may just piss him off and that may not be worth the awkward neighbor relationship you'll have after that.

    3. It may not be weed, it may be Swisher Sweets, It may be Cloves, it may be black and milds it may be cigars it may camel ****, who knows. You may just want to ask him if you're not too intimidated.
