I'm also going to be contacting the clerk of courts family division today pertaining to this to get feed back from them as well.. I am about to be going through a very nasty nasty divorce I have a seven year old son my soon to be can't happen fast enough ex husband has emailed me threats that if I leave with our son he will make my life hell, that i'm not taking him with me I was was going to try to just suck it up and stay here until the divorce was finalized to keep my son in one home not two meaning see if I actually would have to move or i would get the house.. but I can't stay here anymore I have to get out of this..Can I file for temporary custody and take my son with me? . He's a good dad the child would not be in danger staying with him but I worry if I move out before the divorce is final they will say I abandoned my child...I have also saved every nasty email too. thanks for any help I appreciate it

Get a lawyer ASAP. They can advise you and file all the stuff you need to protect yourself and your son. Save all the emails, print them out and take them to the attorney.

This is all domestic stuff, unless it actually does something to harm you, the police can't do a thing to help you.

Do everything the lawyer says and nothing the lawyer tells you not to. My lawyer once told me that peoples' IQ's drop 40 points during a divorce and I believe. Not only because of mine, but all the situations I've responded to over the years.

I'm sorry you are going thru this. I just went thru a very bad one and am still getting screwed. I can't add anything but just echo retdet advice. I also have nothing good to say about divorce court other than it's as F'ed up as the criminal court.

well too late for it not turning domestic :( tonight as I was leaving he ambushed me from behimd pushing me to thr ground as hard as he could then threatened to break a bottle on my head if I did'nt get up in 3 secs my seven year old son witnessed all of this.. I got up went inside grabbed as many clothes as I could and he's screaming he will burn the house down... he's obviously NUTS so I left went to the local PD pressed charges and got copies of the report tomorrow i will be getting a restraining order the really really sad thing is my son has the events memorized..... life will be better on the otherside....

I don't know how it is in your neck of the woods (Florida), but in California (Liberalnation), if there are custody papers with the divorce, most of them have a small clause (unless otherwise specified) that makes it "illegal" for you to take the children to another state, country, over 90 miles.

Yes it's the same in Fl. Life on the other side I have no intention of crossing the border or leaving Fl . I meant being single . I'm contacting a lawyer today, filing for temporary custody of my son and obtaining a restraining order . We've been married for eight yrs and the signs have always been there he needs more help then what I can give him or would want to give him I'm done.

It's worse. When I went through my first, my lawyer got up started, "My client, Mr. B is a police officer......." The judge interrupted him, held up her hand and said, "Stop right there, I've heard all the sob stories from police officers I care to hear". Not hard to guess how that turned out.....

I had a couple more and I never let them get to court again. I settled with my ex's out of court. I gave up a lot, but I knew in the long run that a judge would take more. That's why I still have 100% of my pension, I gave up all of today's dollars to retain tomorrow's. A judge would have never let that happen.

There is no settling this out of court before the above happened maybe.... but he just met his match my goal is to crush, conquer , and win I am filing for half of everything even the pet rabbits.........he just thought he had a bad life...this will be the first time he will have ever taken responsibility for his actions and I'm going to make sure that happens ...I'm not going to be nasty but we've been together eight years and i have worked the whole time my part is owed to me.... need i also mention he has a 40,000$ truck and a 30,000$ boat sitting in the drive way.....

At least here when you get the temporary PFA there is usually a section for child custody. It usually changes after the final hearing though.

Before I can file for temporary custody I have to file for the divorce waiting for my check from Hospice which will be next week. I had to deal with DCF on my doorstep yesterday I went to the home to get some of my stuff he was not present .The detective working the case called me this morning and advised to have a meeting with me. My guess is the states attorney office might pick it up.
