    Texas Provisional License Penalties

    My friend, who is 16, was driving with two people in his car who were not family members and he is still under his 6 month restrictions. A police officer pulled him over for "unsafe lane changing" and he was given a ticket to appear in court by Sept. 1st for having more than one person in his car with him. Will his license be suspended or is it more probable that he will just receive a fine?

    He received the violation through the city therefore he pays the fine to the city. The suspension on his drivers license would come from the Department of public safety. Although he pays the fine to the city or county, DPS will be notified of the violation and DL suspension could follow. His best bet would be to call his local DPS office and ask them. Tell your buddy that having a drivers license in Texas is a privilege not a right. TXDPS has a low tolerance for violators (especially ones who just got their license and can't follow a simple rule). Your friend was privileged with a drivers license and he chose to violate the law a short time later. Unless there was some type of emergency there is no excuse for him to violate the law. When I say emergency I mean he was driving someone to the hospital who was near death.
