    Illegal Credit Check

    State of Washington.

    I have been dating my boyfriend for 7 months. He has 2 children with his ex-wife. His ex-wife works in the loan dept. for a large bank. She has taken it upon herself to state that she will do a background/credit check on me and anyone he chooses to date. She got my information from the internet not myself or him.

    She did a credit check, got my private information and now tries to contact me via my unlisted phone numbers, e-mails etc.

    I have a report prepared to report to the bank.

    She has a history of psychotic behavior and is about to lose her children. We picked them up a few days ago and they were badly beaten and bruised. We have gone to the sheriff with this and protective orders are underway.

    My question is, is am I able to report the illegal background check to the police first?
    Does this constitute a crime?

    Or do I go straight to the bank?

    Go to the police first. She likely committed at least one crime.

    Maybe identity fraud
    Maybe unauthorized access to a computer system
    Maybe forgery

    These crimes vary from state to state.

    You need proof she ran your creit report. Take that to the cops and then, head over to the Bank President. Advise his bank ran your credit, the circumctances and that you want immediate action, and depending on if what they do is reasonable, you may not have to hire a lawyer...as you are well aware running such without your written authorization violates the Fair Credit Reporting Act, Public Law No. 91-508, and have recourse, including complaints with the Federal Reserve, Federal Savings and Loans and local media.

    For what it's worth...

    A credit report will identify the entity making the credit inquiry as well as the type of inquiry made.*

    In my experience an inquiring entity is subject to auditing and therefore logs each request down to the employee profile.*

    With your cr in hand you should be able to force the entity into explaining the reason.*

    In a case I was involved in the employee was ultimately terminated but no criminal charges resulted.

    You caught me sleeping there. Actually the last three were the major with Innovis not so much.

    If the entity has no explanation and the victim wishes to pursue it, it might bump directly to the federal level (such as the FTC)---but I'm a little rusty here just like my math.
